Section 1 of the bill amends Alaska's existing consumer protection statute (AS 45.50.471(b)) to add a new paragraph making any violation of the social media minor-protection provisions in AS 45.50.650 an unlawful trade practice. This hooks the new obligations into the attorney general's existing enforcement authority under the consumer protection act.
(a) 1 A social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) shall prohibit an individual who is under 16 years of age and a resident of the state from becoming an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) on the social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5).
(b) 2 A social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) shall terminate any account held by an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who is under 16 years of age and a resident of the state, including accounts that the social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) treats or categorizes as belonging to an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who is likely under 16 years of age for the purpose of targeted content or advertising. (c) 3 A social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) shall allow an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who is under 16 years of age and a resident of the state to request to terminate the account. (d) 4 A social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) shall permanently delete all information held by the social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) relating to an account terminated under this section, unless the social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) is required by law to retain the information.
(e) 5 A social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) may not use the personal data of an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who is under 18 years of age and a resident of the state in a personalized recommendation systemPersonalized recommendation system"personalized recommendation system" means a fully or partially automated system used to suggest, promote, or rank content, including other account holders or posts, based on information about an account holder;AS 45.50.690(4) to display content on the platform. This subsection does not prohibit a social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) from displaying user-generated content that has been selected, followed, or subscribed to by an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who is under 18 years of age as long as the display of the content is based on a chronological format.
Section 45.50.650 is the bill's core operative provision, imposing five distinct obligations on social media platforms regarding minor users who are Alaska residents. Subsection (a) categorically prohibits platforms from allowing under-16 users to create accounts. Subsection (b) requires termination of existing under-16 accounts — including those the platform internally categorizes as likely under-16 — with a 90-day dispute window. Subsection (c) requires platforms to honor an under-16 user's own request to terminate within five business days.
Subsection (d) imposes a data-deletion mandate for all accounts terminated under this section. Subsection (e) prohibits the use of personal data of any account holder under 18 in personalized recommendation systems, though chronological display of user-selected content is expressly excluded from the prohibition.
(a) In addition to the remedies available to the attorney general under AS 45.50.471 - 45.50.561, a court may award punitive damages if a social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) has engaged in a pattern of knowingly or recklessly violating AS 45.50.650.
(b) Notwithstanding AS 45.50.531 and 45.50.535, a private person may not bring an action under AS 45.50.471 - 45.50.561 for a violation of AS 45.50.650.
(c) The attorney general may adopt regulations under AS 44.62 (Administrative Procedure Act) to implement AS 45.50.650 - 45.50.690.
Section 45.50.660 establishes the enforcement framework for the bill's obligations. Subsection (a) authorizes courts to award punitive damages when a platform has engaged in a pattern of knowing or reckless violations. Subsection (b) expressly bars private persons from bringing actions under Alaska's general consumer protection act (AS 45.50.471–45.50.561) for violations of the social media provisions — channeling private enforcement exclusively through the dedicated private cause of action in AS 45.50.670. Subsection (c) grants the attorney general rulemaking authority to implement the article.

(b) An action under this section must be brought on behalf of the account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) by the account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1)'s parent or guardian.
(c) An action under this section must be brought within one year after the account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1)'s parent or guardian discovered or reasonably should have discovered the alleged violation.
(d) Nothing in this section prevents an account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1) who brings an action under this section from pursuing other remedies available to the account holderAccount holder"account holder" means an individual who (A) opens an account or creates a profile with a social media platform; or (B) is identified by a social media platform by a unique identifier while using or accessing the social media platform;AS 45.50.690(1).
Section 45.50.670 creates a dedicated private right of action for minor account holders harmed by knowing or reckless violations of AS 45.50.650. The action must be brought by a parent or guardian on the minor's behalf. The statute of limitations is one year from the date the parent or guardian discovered or reasonably should have discovered the violation. A savings clause preserves the account holder's right to pursue other available remedies.

(B) pages with no visible or apparent end or page breaks; (C) push notifications or alerts sent by the social media platformSocial media platform"social media platform" (A) means an online forum, website, or application that allows users to upload content or view the content or activity of other users and employs algorithms that analyze user data or information about users to select content for users; (B) does not include an online service, website, or application in which the exclusive function is electronic mail or direct messaging consisting of text, images, or videos shared only between the sender and the recipient, without displaying or posting publicly or to other users not specifically identified as recipients by the sender.AS 45.50.690(5) about specific activities or events; (D) personal interactive metrics that display the number of times other users have clicked a button to indicate a reaction to content or have shared or reposted the content; (E) video that begins to play automatically or without the user first clicking on the video or on a play button for that video; (F) live streaming or another function that broadcasts live video content in real time.
Section 45.50.680 limits the bill's scope to social media platforms meeting a two-part test: (1) at least 10% of the platform's under-18 daily active users average two or more hours per day on the platform, and (2) the platform employs at least one of six enumerated addictive features — infinite scroll, pages with no visible end, push notifications, engagement metrics (likes/shares), autoplay video, or live streaming. This threshold test operates as a coverage gate — platforms that do not meet both prongs are not subject to the article's obligations.
