Enforcement Authority
Violations of certain provisions of Article 1 (§ 44-8042(B)(2)–(4)) constitute unlawful practices under A.R.S. § 44-1522 and are enforceable through the Arizona Consumer Fraud Act framework, which provides enforcement by the Arizona Attorney General. Article 2 does not specify an enforcement mechanism or designated enforcer. A civil action under Article 1 must be brought within one year of the date the complainant knew or reasonably should have known of the violation.
Private Right of Action
No private right of action. Enforcement is exclusive to the designated authority.
Penalties
Article 1 incorporates violations as unlawful practices under A.R.S. § 44-1522, which makes available the remedies of the Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.), including injunctive relief, restitution, and civil penalties sought by the Attorney General. Definitions (Article 1 — Social Media)

In this article, unless the context otherwise requires:

(1) "Account holderAccount holder"Account holder" means a resident who opens an account or creates a profile or who is identified by a social media platform by a unique identifier while using or accessing the social media platform when the social media platform knows or has reason to believe the resident is located in this state.A.R.S. § 44-8041(1)" means a residentResident"Resident" means a person who lives in this state for more than six months of the year.A.R.S. § 44-8041(4) who opens an account or creates a profile or who is identified by a social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (iv) Has infinite scrolling or Seamless content or the use of webpages with no visible or apparent end or page breaks, has Push notifications or alerts sent by an online forum, website or application to inform a user about specific activities or events related to the user's account, displays personal interactive metrics that indicate the number of times other users have clicked a button to indicate the users' reactions to content or have shared or reposted the content, has auto-play video or video that begins to play without the user first clicking on the video or on a play button for that video or has live-streaming or has a function that allows a user or advertiser to broadcast live video content in real-time. (2) "Daily active usersDaily active users"Daily active users" means the number of unique users in the United States who used the social media platform at least eighty percent of the days during either: (a) The previous twelve-month period. (b) The previous one month period if the social media platform did not exist during the previous twelve-month period.A.R.S. § 44-8041(2)" means the number of unique users in the United States who used the social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (3) "Infinite scrollingInfinite scrolling"Infinite scrolling" means content that is continuously loading or content that loads as the user scrolls down the webpage without the need to open a separate webpage.A.R.S. § 44-8041(3)" means content that is continuously loading or content that loads as the user scrolls down the webpage without the need to open a separate webpage.

(4) "ResidentResident"Resident" means a person who lives in this state for more than six months of the year.A.R.S. § 44-8041(4)" means a person who lives in this state for more than six months of the year.

(5) "Social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (ii) Ten percent or more of the daily active users who are less than sixteen years of age spent on average at least two hours per day on the online forum, website or application on the days when using the online forum, website or application during the previous twelve months or, if the online forum, website or application did not exist during the previous twelve months, during the previous one-month period. (iii) Employs algorithms that analyze user data or information on users to select content for users. (iv) Has infinite scrolling or Seamless content or the use of webpages with no visible or apparent end or page breaks, has Push notifications or alerts sent by an online forum, website or application to inform a user about specific activities or events related to the user's account, displays personal interactive metrics that indicate the number of times other users have clicked a button to indicate the users' reactions to content or have shared or reposted the content, has auto-play video or video that begins to play without the user first clicking on the video or on a play button for that video or has live-streaming or has a function that allows a user or advertiser to broadcast live video content in real-time. Section 44-8041 establishes the definitions for Article 1, governing social media platforms. The most consequential definition is social media platform, which imposes a four-part conjunctive test: user-generated content capability, a quantitative minor-usage threshold (10%+ of daily active users under 16 spending 2+ hours per day), algorithmic content selection, and the presence of at least one specified engagement feature (infinite scrolling, push notifications, interactive metrics, auto-play video, or live-streaming). The minor-usage threshold is notably specific and may exclude platforms that have significant minor audiences but fall below the daily usage intensity requirement.

The definition of account holder is limited to Arizona residents or persons the platform knows or has reason to believe are located in Arizona, which scopes the bill's substantive obligations geographically.

(iv) Has infinite scrolling or Seamless content or the use of webpages with no visible or apparent end or page breaks, has Push notifications or alerts sent by an online forum, website or application to inform a user about specific activities or events related to the user's account, displays personal interactive metrics that indicate the number of times other users have clicked a button to indicate the users' reactions to content or have shared or reposted the content, has auto-play video or video that begins to play without the user first clicking on the video or on a play button for that video or has live-streaming or has a function that allows a user or advertiser to broadcast live video content in real-time. (B)(4) 4 Permanently delete all personal information held by the social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (ii) Ten percent or more of the daily active users who are less than sixteen years of age spent on average at least two hours per day on the online forum, website or application on the days when using the online forum, website or application during the previous twelve months or, if the online forum, website or application did not exist during the previous twelve months, during the previous one-month period. (iii) Employs algorithms that analyze user data or information on users to select content for users. (iv) Has infinite scrolling or Seamless content or the use of webpages with no visible or apparent end or page breaks, has Push notifications or alerts sent by an online forum, website or application to inform a user about specific activities or events related to the user's account, displays personal interactive metrics that indicate the number of times other users have clicked a button to indicate the users' reactions to content or have shared or reposted the content, has auto-play video or video that begins to play without the user first clicking on the video or on a play button for that video or has live-streaming or has a function that allows a user or advertiser to broadcast live video content in real-time. (b) Does not include an online service, website or application where the exclusive function is email or direct messaging consisting of text, photographs, pictures, images or videos that are shared only between the sender and the recipients and that are not displayed or posted publicly or to other users that are not specifically identified by the sender as the recipients.A.R.S. § 44-8041(5) relating to the terminated account, unless there are legal requirements to maintain the information.

(B)(5) 5 Terminate an account held by an account holderAccount holder"Account holder" means a resident who opens an account or creates a profile or who is identified by a social media platform by a unique identifier while using or accessing the social media platform when the social media platform knows or has reason to believe the resident is located in this state.A.R.S. § 44-8041(1) who is fourteen or fifteen years of age, including an account that the social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (ii) Ten percent or more of the daily active users who are less than sixteen years of age spent on average at least two hours per day on the online forum, website or application on the days when using the online forum, website or application during the previous twelve months or, if the online forum, website or application did not exist during the previous twelve months, during the previous one-month period. (iii) Employs algorithms that analyze user data or information on users to select content for users. (ii) Ten percent or more of the daily active users who are less than sixteen years of age spent on average at least two hours per day on the online forum, website or application on the days when using the online forum, website or application during the previous twelve months or, if the online forum, website or application did not exist during the previous twelve months, during the previous one-month period. (iii) Employs algorithms that analyze user data or information on users to select content for users. (iv) Has infinite scrolling or Seamless content or the use of webpages with no visible or apparent end or page breaks, has Push notifications or alerts sent by an online forum, website or application to inform a user about specific activities or events related to the user's account, displays personal interactive metrics that indicate the number of times other users have clicked a button to indicate the users' reactions to content or have shared or reposted the content, has auto-play video or video that begins to play without the user first clicking on the video or on a play button for that video or has live-streaming or has a function that allows a user or advertiser to broadcast live video content in real-time. (b) Does not include an online service, website or application where the exclusive function is email or direct messaging consisting of text, photographs, pictures, images or videos that are shared only between the sender and the recipients and that are not displayed or posted publicly or to other users that are not specifically identified by the sender as the recipients.A.R.S. § 44-8041(5) relating to a terminated account, unless there are legal requirements to maintain the information.

(C) A knowing or reckless violation of subsection B, paragraph 2, 3 or 4 of this section is an unlawful practice pursuant to section 44-1522.

(D) Notwithstanding any other law, a civil action for a claim under this section must be brought within one year after the date that the complainant knew or reasonably should have known of the violation.

Section 44-8042 imposes the bill's core substantive obligations on social media platforms, organized around two age brackets: under 14 and 14–15. For children under 14, platforms must obtain parental consent before allowing account creation and must terminate accounts lacking consent. For 14- and 15-year-olds, platforms must terminate accounts unless parental consent is obtained. Both age groups receive account termination request rights (5 business days for the minor, 10 business days for a parent or guardian), and platforms must permanently delete all personal information associated with terminated accounts unless legally required to retain it.

Subsection C designates knowing or reckless violations of the minor's self-termination right (B.2), the parental termination right (B.3), and the data deletion duty (B.4) as unlawful practices under A.R.S. § 44-1522, incorporating them into Arizona's Consumer Fraud Act enforcement framework. Notably, the parental consent requirement (B.1/B.5), the platform-initiated termination duties, and the 14–15 age bracket obligations in paragraphs 5–8 are not designated as unlawful practices, leaving their enforcement mechanism unclear.

Subsection D imposes a one-year statute of limitations running from the date the complainant knew or reasonably should have known of the violation.

Section 44-8051 establishes the definitions for Article 2, governing online age verification for material harmful to minors. Key definitions include anonymous age verification, which must be conducted by a nongovernmental, independent, U.S.-organized third party not owned or controlled by a foreign entity, and substantial portion, set at more than 33.3% of total material on a website or application. The harmful to minors definition incorporates A.R.S. § 13-3501 by reference, tying the obligation to Arizona's existing obscenity framework.

The commercial entity definition is broadly inclusive of all legally recognized business forms but is distinct from the social media platform definition in Article 1 — these are separate regulatory regimes with different covered entities.

Section 44-8052 imposes age verification and access-prevention duties on commercial entities that knowingly and intentionally publish or distribute material harmful to minors on websites or applications where such material constitutes a substantial portion (more than 33.3%) of total content. The section requires a dual scienter showing — both knowledge and intent — which sets a higher bar than the Article 1 obligations.
