Enforcement Authority
Violations of certain subsections constitute unlawful practices under A.R.S. § 44-1522 (Arizona Consumer Fraud Act), enforceable by the Arizona Attorney General. The bill does not create an express private right of action, but Arizona Consumer Fraud Act § 44-1528 permits private civil actions for violations of § 44-1522. A one-year statute of limitations applies from the date the complainant knew or reasonably should have known of the violation.
Private Right of Action

Definitions (Article 1 — Social Media)

In this article, unless the context otherwise requires: 1. "Account holderAccount holder"Account holder" means a resident who opens an account or creates a profile or who is identified by a social media platform by a unique identifier while using or accessing the social media platform when the social media platform knows or has reason to believe the resident is located in this state.A.R.S. § 44-8041(1)" means a residentResident"Resident" means a person who lives in this state for more than six months of the year.A.R.S. § 44-8041(4) who opens an account or creates a profile or who is identified by a social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. Section 44-8041 defines terms used throughout Article 1 (Social Media). The key defined term is social media platform, which requires four cumulative criteria: user-generated content capability, at least 10% of daily active users under 16 spending 2+ hours/day, algorithmic content selection, and at least one addictive design feature (infinite scrolling, push notifications, personal interactive metrics, auto-play video, or live-streaming). Email and direct messaging services are excluded.

The definition is notable for its engagement-threshold trigger — a platform is not covered unless it can demonstrate the minor-usage metric, which creates a data-dependent compliance question for borderline platforms.

Account holder contracts; duties; unfair practice; statute of limitations

(B)(5) 4 Terminate an account held by an account holderAccount holder"Account holder" means a resident who opens an account or creates a profile or who is identified by a social media platform by a unique identifier while using or accessing the social media platform when the social media platform knows or has reason to believe the resident is located in this state.A.R.S. § 44-8041(1) who is fourteen or fifteen years of age, including an account that the social media platformSocial media platform"Social media platform": (a) means an online forum, website or application that satisfies each of the following criteria: (i) Allows a user to upload content or view the content or activity of other users. (C)–(D) C. A knowing or reckless violation of subsection B, paragraph 2, 3 or 4 of this section is an unlawful practice pursuant to section 44-1522. D. Notwithstanding any other law, a civil action for a claim under this section must be brought within one year after the date that the complainant knew or reasonably should have known of the violation.
