(a) As used in this section: (1) "EmployerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. (b) 1 An employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) may only engage in electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) in order to: (1) Ensure the quality of goods and services; (2) conduct periodic assessments of employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. (c) 2 It shall be a violation of this section for an employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Stat. § 31-48d(a)(1) to engage in any type of electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) to: (1) Threaten the health, safety and welfare of employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. (d) 3 No employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) shall require an employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Stat. § 31-48d(a)(2) to wear a monitoring device or install an application on an employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2)'s personal device for purposes of location tracking.
(e)(1) 4 Except as provided in subdivision (3) of this subsection, each employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Stat. § 31-48d(a)(1) who engages in any type of electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) shall give prior written notice to all employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Stat. § 31-48d(a)(2) who may be affected, informing them of the types of monitoring which may occur, the intended use of any information collected by such monitoring and how any information collected will be stored and for how long. Such written notice shall include a statement of the employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2)' rights under this section. The notice required pursuant to this subdivision shall be provided (A) in plain language, and (B) in English and the primary language of the employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2).
(e)(2) 4 Each employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) shall post, in a conspicuous place which is readily available for viewing by its employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. (e)(3) 4 When (A) an employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) has reasonable grounds to believe that employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2) are engaged in conduct which (i) violates the law, (ii) violates the legal rights of the employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) or the employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1)'s employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(3) may produce evidence of this misconduct, the employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) may conduct monitoring without giving prior written notice.
(f) 5 An employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) who engages in electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) shall not sell, transfer or disclose employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2) information collected by such electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) to another person or entity, except where such employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1) is required to do so under state or federal law or to comply with an impact assessment pursuant to section 3 of this act.
(g) The Labor Commissioner may levy a civil penalty against any person that the commissioner finds to be in violation of subsections (b) to (f), inclusive, of this section, after a hearing conducted in accordance with sections 4-176e to 4-184, inclusive. The maximum civil penalty shall be five hundred dollars for the first offense, one thousand dollars for the second offense and three thousand dollars for the third and each subsequent offense.
(h) The provisions of this section shall not apply to a criminal investigation. Any information obtained in the course of a criminal investigation through the use of electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) may be used in a disciplinary proceeding against an employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2).
Section 1 substantially rewrites Connecticut's existing electronic monitoring statute to impose new substantive restrictions on employer workplace surveillance. Under the amended law, electronic monitoring may only be conducted for six enumerated purposes — quality assurance, performance assessment, legal compliance, employee health and safety, facility and network security, and wage and benefit administration — and must be narrowly tailored to the intended purpose in the manner least invasive to employees. The bill adds an entirely new prohibition list: employers may not use electronic monitoring to threaten employee health or safety, monitor off-duty activity, collect medical history, obtain biometric identifiers, collect protected-class data, or punish protected activity. Location-tracking via employer-mandated devices or personal-device apps is separately banned.
The amended notice requirements now require employers to inform employees of the types of monitoring, the intended use of collected information, how data will be stored and for how long, and employees' rights under the section — all in plain language and in the employee's primary language. Sale, transfer, or disclosure of employee monitoring data to third parties is prohibited except where required by law or needed for an impact assessment under Section 3. The Labor Commissioner enforces violations with escalating civil penalties of $500, $1,000, and $3,000 per offense.

Stat. § 31-48d(a)(1) shall operate any electronic surveillance device or system, including, but not limited to, the recording of sound or voice or a closed circuit television system, or any combination thereof, for the purpose of recording or monitoring the activities of such employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1)'s employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Section 2 amends the existing prohibition on employer electronic surveillance to extend coverage beyond personal-comfort areas (restrooms, locker rooms, lounges) to include any property owned or leased by an employee, such as an employee's residence or vehicle. This directly addresses remote-work surveillance scenarios by making it unlawful for employers to operate recording or monitoring equipment in employee homes.
(a) As used in this section and sections 4 to 8, inclusive, of this act: (1) "Algorithmic discriminationAlgorithmic discrimination"Algorithmic discrimination" (A) means any condition in which the use of an artificial intelligence system results in any unlawful differential treatment or impact that disfavors any individual or group of individuals on the basis of their actual or perceived age, color, disability, ethnicity, genetic information, limited proficiency in the English language, national origin, race, religion, reproductive health, sex, gender identity, veteran status or other classification protected under the laws of this state or federal law, and (B) does not include (i) the offer, license or use of a high-risk artificial intelligence system by a developer or deployer for the sole purpose of (I) the developer's or deployer's self-testing to identify, mitigate or prevent discrimination or otherwise ensure compliance with state and federal law, or (II) expanding an applicant, customer or participant pool to increase diversity or redress historic discrimination, or (ii) an act of omission by or on behalf of a private club or other establishment not in fact open to the public, as set forth in Title II of the Civil Rights Act of 1964, 42 USC 2000a(e), as amended from time to time.Sec. 3(a)(1)" (A) means any condition in which the use of an artificial intelligence systemArtificial intelligence system"Artificial intelligence system" means any machine-based system that, for any explicit or implicit objective, infers from the inputs such system receives how to generate outputs, including, but not limited to, content, decisions, predictions or recommendations, that can influence physical or virtual environments.Sec. 3(a)(2) results in any unlawful differential treatment or impact that disfavors any individual or group of individuals on the basis of their actual or perceived age, color, disability, ethnicity, genetic information, limited proficiency in the English language, national origin, race, religion, reproductive health, sex, gender identity, veteran status or other classification protected under the laws of this state or federal law, and (B) does not include (i) the offer, license or use of a high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) by a developer or deployer for the sole purpose of (I) the developer's or deployer's self-testing to identify, mitigate or prevent discrimination or otherwise ensure compliance with state and federal law, or (II) expanding an applicant, customer or participant pool to increase diversity or redress historic discrimination, or (ii) an act of omission by or on behalf of a private club or other establishment not in fact open to the public, as set forth in Title II of the Civil Rights Act of 1964, 42 USC 2000a(e), as amended from time to time; (2) "Artificial intelligence systemArtificial intelligence system"Artificial intelligence system" means any machine-based system that, for any explicit or implicit objective, infers from the inputs such system receives how to generate outputs, including, but not limited to, content, decisions, predictions or recommendations, that can influence physical or virtual environments.Sec. 3(a)(2)" means any machine-based system that, for any explicit or implicit objective, infers from the inputs such system receives how to generate outputs, including, but not limited to, content, decisions, predictions or recommendations, that can influence physical or virtual environments; (3) "Consequential decisionConsequential decision"Consequential decision" means any decision or judgment that has a legal, material or similarly significant effect on an individual with respect to (A) employment, including, but not limited to, any such decision or judgment made (i) concerning hiring, termination, compensation or promotion, (ii) concerning hours, duties, productivity requirements, workplace health and safety or other conditions of employment, or (iii) by way of any automated task allocation that limits, segregates or classifies employees for the purpose of assigning or determining material terms or conditions of employment, (B) education or vocational training, including, but not limited to, any such decision or judgment made concerning (i) assessments, (ii) student cheating or plagiarism detection, (iii) accreditation, (iv) certification, (v) admissions, or (vi) financial aid or scholarships, (C) the provision or denial, or terms and conditions, of (i) financial lending or credit services, (ii) housing or lodging, including, but not limited to, rentals or short-term housing or lodging, (iii) insurance, or (iv) legal services, or (D) the provision or denial of (i) essential government services, or (ii) health care services.Sec. 3(a)(3)" means any decision or judgment that has a legal, material or similarly significant effect on an individual with respect to (A) employment, including, but not limited to, any such decision or judgment made (i) concerning hiring, termination, compensation or promotion, (ii) concerning hours, duties, productivity requirements, workplace health and safety or other conditions of employment, or (iii) by way of any automated task allocation that limits, segregates or classifies employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Stat. § 31-48d(a)(2) for the purpose of assigning or determining material terms or conditions of employment, (B) education or vocational training, including, but not limited to, any such decision or judgment made concerning (i) assessments, (ii) student cheating or plagiarism detection, (iii) accreditation, (iv) certification, (v) admissions, or (vi) financial aid or scholarships, (C) the provision or denial, or terms and conditions, of (i) financial lending or credit services, (ii) housing or lodging, including, but not limited to, rentals or short-term housing or lodging, (iii) insurance, or (iv) legal services, or (D) the provision or denial of (i) essential government services, or (ii) health care services; (4) "DeployDeploy"Deploy" means to use electronic monitoring or a high-risk artificial intelligence system.Sec. 3(a)(4)" means to use electronic monitoringElectronic monitoring"Electronic monitoring" means the collection of information on an employer's premises concerning employees' activities or communications by any means other than direct observation or obtaining employee data from a third party, including the use of a computer, telephone, wire, radio, camera, electromagnetic, photoelectronic or photo-optical systems, but not including the collection of information (A) for security purposes in common areas of the employer's premises which are held out for use by the public, or (B) which is prohibited under state or federal law.Conn. Gen. Stat. § 31-48d(a)(3) or a high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5); (5) "High-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5)" (A) means any artificial intelligence systemArtificial intelligence system"Artificial intelligence system" means any machine-based system that, for any explicit or implicit objective, infers from the inputs such system receives how to generate outputs, including, but not limited to, content, decisions, predictions or recommendations, that can influence physical or virtual environments.Sec. 3(a)(2) that, when deployed, makes, or is a substantial factorSubstantial factor"Substantial factor" (A) means a factor that (i) alters the outcome of a consequential decision, and (ii) is generated by an artificial intelligence system, (B) includes, but is not limited to, any use of an artificial intelligence system to generate any content, decision, prediction or recommendation concerning an individual that is used as a basis to make a consequential decision concerning the individual, and (C) does not include any output produced by an artificial intelligence system where an individual was involved in the data processing that produced such output and such individual (i) meaningfully considered such data as part of such data processing, and (ii) had the authority to change or influence the output produced by such data processing.Sec. 3(a)(6) in making, a consequential decisionConsequential decision"Consequential decision" means any of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful; and (6) "Substantial factorSubstantial factor"Substantial factor" (A) means a factor that (i) alters the outcome of a consequential decision, and (ii) is generated by an artificial intelligence system, (B) includes, but is not limited to, any use of an artificial intelligence system to generate any content, decision, prediction or recommendation concerning an individual that is used as a basis to make a consequential decision concerning the individual, and (C) does not include any output produced by an artificial intelligence system where an individual was involved in the data processing that produced such output and such individual (i) meaningfully considered such data as part of such data processing, and (ii) had the authority to change or influence the output Gen. Stat. § 31-48d(a)(1) shall contract with an impartial third party to complete an impact assessment of the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5). (2) Each impact assessment completed pursuant to this subsection shall include, at a minimum, and to the extent known by, or available to, the employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. (B) Any metrics used to evaluate the performance and known limitations of the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5); (C) An analysis of the error rates of the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5); (D) An analysis of whether the deployment of the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) poses any known or reasonable foreseeable risks of algorithmic discriminationAlgorithmic discrimination"Algorithmic discrimination" (A) means any condition in which the use of an artificial intelligence system results in any unlawful differential treatment or impact that disfavors any individual or group of individuals on the basis of their actual or perceived age, color, disability, ethnicity, genetic information, limited proficiency in the English language, national origin, race, religion, reproductive health, sex, gender identity, veteran status or other classification protected under the laws of this state or federal law, and (B) does not include (i) the offer, license or use of a high-risk artificial intelligence system by a developer or deployer for the sole purpose of (I) the developer's or deployer's self-testing to identify, mitigate or prevent discrimination or otherwise ensure compliance with state and federal law, or (II) expanding an applicant, customer or participant pool to increase diversity or redress historic discrimination, or (ii) an act of omission by or on behalf of a private club or other establishment not in fact open to the public, as set forth in Title II of the Civil Rights Act of 1964, 42 USC 2000a(e), as amended from time to time.Sec. 3(a)(1); (E) An analysis of the accessibility of the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5); (F) An analysis of the potential impacts the high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) has on employeesEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Stat. § 31-48d(a)(1) deploysDeploy"Deploy" means to use electronic monitoring or a high-risk artificial intelligence system.Sec. 3(a)(4) a high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) to make, or be a substantial factorSubstantial factor"Substantial factor" (A) means a factor that (i) alters the outcome of a consequential decision, and (ii) is generated by an artificial intelligence system, (B) includes, but is not limited to, any use of an artificial intelligence system to generate any content, decision, prediction or recommendation concerning an individual that is used as a basis to make a consequential decision concerning the individual, and (C) does not include any output produced by an artificial intelligence system where an individual was involved in the data processing that produced such output and such individual (i) meaningfully considered such data as part of such data processing, and (ii) had the authority to change or influence the output produced by such data processing.Sec. 3(a)(6) in making, a consequential decisionConsequential decision"Consequential decision" means any decision or judgment that has a legal, material or similarly significant effect on an individual with respect to (A) employment, including, but not limited to, any such decision or judgment made (i) concerning hiring, termination, compensation or promotion, (ii) concerning hours, duties, productivity requirements, workplace health and safety or other conditions of employment, or (iii) by way of any automated task allocation that limits, segregates or classifies employees for the purpose of assigning or determining material terms or conditions of employment, (B) education or vocational training, including, but not limited to, any such decision or judgment made concerning (i) assessments, (ii) student cheating or plagiarism detection, (iii) accreditation, (iv) certification, (v) admissions, or (vi) financial aid or scholarships, (C) the provision or denial, or terms and conditions, of (i) financial lending or credit services, (ii) housing or lodging, including, but not limited to, rentals or short-term housing or lodging, (iii) insurance, or (iv) legal services, or (D) the provision or denial of (i) essential government services, or (ii) health care services.Sec. 3(a)(3) concerning an employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5), and (E) is provided the time and resources in order to evaluate the outputs produced by such high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5). (2) The internal reviewer designated pursuant to subdivision (1) of this subsection shall verify the accuracy of employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Section 3 is the bill's centerpiece, creating a comprehensive framework for employers deploying high-risk AI systems in consequential employment decisions. It defines key terms — algorithmic discrimination, artificial intelligence system, consequential decision, high-risk artificial intelligence system, and substantial factor — and then imposes three layers of obligation: pre-deployment impact assessment, pre-decision employee notice and disclosure, and ongoing human oversight.
The impact assessment must be completed by an impartial third party no later than one year before deployment and must cover the system's purpose, performance metrics, error rates, algorithmic discrimination risk, accessibility, employee-rights impacts, and effects on job quality or well-being. For systems already deployed before October 1, 2025, the assessment must be completed by October 1, 2026. Beginning October 1, 2026, employers must notify employees before using a high-risk AI system in a consequential decision, disclose the system's purpose, nature of the decision, data collected, impact assessment results, opt-out rights, and appeal procedures. When a consequential decision is adverse, additional post-decision protections apply: the employer must disclose the principal reasons for the decision, the degree of AI contribution, the data types and sources, and must give the employee the right to examine and correct personal data and to appeal inaccurate-data-based decisions with human review. The employer must also designate at least one qualified internal reviewer with authority to change AI outputs.
11 No employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(2)'s position; (2) Reasonably believed that output may cause algorithmic discriminationAlgorithmic discrimination"Algorithmic discrimination" (A) means any condition in which the use of an artificial intelligence system results in any unlawful differential treatment or impact that disfavors any individual or group of individuals on the basis of their actual or perceived age, color, disability, ethnicity, genetic information, limited proficiency in the English language, national origin, race, religion, reproductive health, sex, gender identity, veteran status or other classification protected under the laws of this state or federal law, and (B) does not include (i) the offer, license or use of a high-risk artificial intelligence system by a developer or deployer for the sole purpose of (I) the developer's or deployer's self-testing to identify, mitigate or prevent discrimination or otherwise ensure compliance with state and federal law, or (II) expanding an applicant, customer or participant pool to increase diversity or redress historic discrimination, or (ii) an act of omission by or on behalf of a private club or other establishment not in fact open to the public, as set forth in Title II of the Civil Rights Act of 1964, 42 USC 2000a(e), as amended from time to time.Sec. 3(a)(1) and notified the employer of such belief; and (3) Reasonably believed that there was not enough time to correct such action before a consequential decisionConsequential decision"Consequential decision" means any decision or judgment that has a legal, material or similarly significant effect on an individual with respect to (A) employment, including, but not limited to, any such decision or judgment made (i) concerning hiring, termination, compensation or promotion, (ii) concerning hours, duties, productivity requirements, workplace health and safety or other conditions of employment, or (iii) by way of any automated task allocation that limits, segregates or classifies employees for the purpose of assigning or determining material terms or conditions of employment, (B) education or vocational training, including, but not limited to, any such decision or judgment made concerning (i) assessments, (ii) student cheating or plagiarism detection, (iii) accreditation, (iv) certification, (v) admissions, or (vi) financial aid or scholarships, (C) the provision or denial, or terms and conditions, of (i) financial lending or credit services, (ii) housing or lodging, including, but not limited to, rentals or short-term housing or lodging, (iii) insurance, or (iv) legal services, or (D) the provision or denial of (i) essential government services, or (ii) health care services.Sec. 3(a)(3) needed to be made.
Section 4 creates an anti-retaliation protection for employees who refuse to follow a consequential decision output from a high-risk AI system. The protection is conditioned on three requirements: the employee must hold independent judgment and discretion under a state license or certification, must have reasonably believed the AI output may cause algorithmic discrimination and notified the employer, and must have reasonably believed there was insufficient time to correct the action before the decision needed to be made. This is a narrow protection designed for licensed professionals — it does not extend to all employees.
An employeeEmployee"Employee" means any person who performs services for an employer in a business of the employer, if the employer has the right to control and direct the person as to (A) the result to be accomplished by the services, and (B) the details and means by which such result is accomplished.Conn. Gen. Stat. § 31-48d(a)(2) aggrieved by a violation of section 3 or 4 of this act may bring a civil action in the Superior Court to recover damages and equitable relief together with costs and reasonable attorney's fees.
Section 5 creates a private right of action for employees aggrieved by a violation of Sections 3 or 4 (the high-risk AI impact assessment, notice, human oversight, and anti-retaliation provisions). Employees may bring a civil action in Superior Court to recover damages and equitable relief together with costs and reasonable attorney's fees. No statutory minimum or maximum is specified for the damages recoverable under this section.
(a)(1) 12 No state agency, or any entity acting on behalf of a state agency, shall, directly or indirectly, utilize or apply any high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) in performing any function that (A) is related to the delivery of any public assistance benefit to individuals in the state by such agency, or (B) will have a material impact on the rights, civil liberties, safety or welfare of individuals in the state, unless such utilization or application is specifically authorized by law.
(a)(2) 13 No state agency shall authorize any procurement, purchase or acquisition of any high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5) utilizing, or relying on, automated decision systems, except where the use of such system is specifically authorized by law.
(a)(3) 14 If a state agency is authorized to procure, purchase or acquire a high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5), the state agency shall contract with an impartial third party to complete an impact assessment pursuant to subsection (b) of section 3 of this act.
(b) 14 Any impact assessment completed pursuant to subdivision (3) of subsection (a) of this section shall be submitted to the Commissioner of Administrative Services, in a form and manner prescribed by the commissioner, and posted on the agency's Internet web site not later than sixty days prior to deployment of such high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" (A) means any artificial intelligence system that, when deployed, makes, or is a substantial factor in making, a consequential decision, and (B) does not include (i) any artificial intelligence system that is intended to (I) perform any narrow procedural task, or (II) detect decision-making patterns, or deviations from decision-making patterns, unless such artificial intelligence system is intended to replace or influence any assessment previously completed by an individual without sufficient human review, or (ii) unless the technology, when deployed, makes, or is a substantial factor in making, a consequential decision, (I) any anti-fraud technology that does not make use of facial recognition technology, (II) any artificial intelligence-enabled video game technology, (III) any anti-malware, anti-virus, calculator, cybersecurity, database, data storage, firewall, Internet domain registration, Internet-web-site loading, networking, robocall-filtering, spam-filtering, spellchecking, spreadsheet, web-caching, web-hosting or similar technology, (IV) any technology that performs tasks exclusively related to an entity's internal management affairs, including, but not limited to, ordering office supplies or processing payments, or (V) any technology that communicates with consumers in natural language for the purpose of providing users with information, making referrals or recommendations and answering questions, and is subject to an accepted use policy that prohibits generating content that is discriminatory or harmful.Sec. 3(a)(5). Any agency may redact any data in such impact statement to remove personally identifiable information of any individual.
Section 6 imposes a near-categorical ban on state agency use of high-risk AI systems in public-assistance and rights-affecting functions unless specifically authorized by law. The prohibition extends to both direct and indirect use, and to entities acting on behalf of state agencies. Procurement and acquisition of high-risk AI systems with automated decision capabilities are likewise prohibited unless specifically authorized. When a state agency is authorized to procure such a system, it must contract with an impartial third party for an impact assessment under Section 3's requirements, submit the assessment to the Commissioner of Administrative Services, and post it on the agency's website at least 60 days before deployment. Agencies may redact personally identifiable information from published assessments.

Stat. § 31-48d(a)(2) organization, to bargain collectively through representatives of their own choosing on questions of wages, hours and other conditions of employment, including, but not limited to, the use of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means any machine-based system that, for any explicit or implicit objective, infers from the inputs such system receives how to generate outputs, including, but not limited to, content, decisions, predictions or recommendations, that can influence physical or virtual environments.Sec. 3(a)(2) by an employerEmployer"Employer" means any person, firm or corporation, including the state and any political subdivision of the state which has employees.Conn. Gen. Stat. § 31-48d(a)(1), and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection, free from actual interference, restraint or coercion.
Section 7 amends the municipal employee collective bargaining statute to add the use of artificial intelligence systems by an employer as a mandatory subject of collective bargaining, alongside wages, hours, and other conditions of employment. This gives municipal employee unions the right to negotiate over employer AI deployment as part of the bargaining process.

Section 8 parallels Section 7 but amends the state employee collective bargaining statute to add the use of artificial intelligence systems by an employer as a mandatory subject of bargaining for state employees, subject to the existing exception in subsection (d) of section 5-272.
