(34) "Public or private institution of higher educationPublic or private institution of higher education"Public or private institution of higher education" means: (a) A state university or a Florida College System institution as those terms are defined in s. 1000.21(8) and (5), respectively; or (b) An independent postsecondary educational institution as defined in s. 1005.02.Fla. This section amends the existing definitions section of Chapter 282, Florida Statutes, to add several AI-related terms. The new definitions establish the conceptual framework for the bill: artificial intelligence system is defined by its perception-action loop and adaptive learning capabilities; automated decision system is scoped specifically to governmental decisions; and two sub-categories — automated final decision system and automated support decision system — distinguish between fully autonomous governmental decisions and AI-assisted human decisions. These definitions are referenced throughout the inventory reporting and advisory council provisions.
(1) The Artificial Intelligence Advisory CouncilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12), an advisory councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) as defined in s. 20.03, is created within the departmentDepartment"Department" means the Department of Management Services.Fla. Stat. § 282.0041(17). Except as otherwise provided in this section, the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. (c) Study and monitor the potential benefits, liabilities, and risks that the state, private residents, and businesses could incur as a result of implemented automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. (d) Recommend administrative and legislative actions that state governmental agencies and the Legislature can use to promote the development of artificial intelligence in this state.
(2)(a)–(d) The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall be composed of the following members, whose appointments must be made by October 1, 2024: 1. Two members of the Senate, appointed by the President of the Senate. 2. Two members of the House of Representatives, appointed by the Speaker of the House of Representatives. 3. An academic professional specializing in ethics who is employed by a public or private institution of higher educationPublic or private institution of higher education"Public or private institution of higher education" means: (a) A state university or a Florida College System institution as those terms are defined in s. 1000.21(8) and (5), respectively; or (b) An independent postsecondary educational institution as defined in s. 1005.02.Fla. Stat. § 282.0041(34), appointed by the Governor. 4. An academic professional specializing in artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. An expert on law enforcement usage of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4), appointed by the Governor. 6. A policy expert, appointed by the Governor. 7. A constitutional and legal rights expert, appointed by the Governor. (b) The members appointed pursuant to subparagraphs (a)1. and 2. shall serve as co-chairs of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12). (c) Each member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall be appointed to a 4-year term; however, for the purpose of providing staggered terms, of the initial appointments, the members appointed pursuant to subparagraphs (a)1. and 2. shall be appointed to 2-year terms, and the other members shall be appointed to 4-year terms. A member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) may be removed at any time by the member's appointing authority, who shall fill the vacancy in the same manner as the original appointment for the remainder of the unexpired term. (d) A member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) may not receive compensation for serving on the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) but may be reimbursed for per diem and travel expenses in accordance with s. 112.061.
(3) The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall meet no later than November 1, 2024, and monthly thereafter, and at other times upon call of the co-chairs.

Stat. § 282.0041(12) shall submit quarterly reports to the Governor, the President of the Senate, and the Speaker of the House of Representatives. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) on the liberty, finances, livelihood, and privacy interests of the residents of this state. (d) Recommendations of policies necessary to accomplish all of the following: 1. Protecting the privacy and interests of the residents of this state from any negative effects caused by artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4). 2. Ensuring that the residents of this state are free from unfair discrimination caused or compounded by artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4). 3. Promoting the development and deployment of artificial intelligence in this state. (e) Any other information the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) considers relevant.
This section creates the Artificial Intelligence Advisory Council within the Department of Management Services. The council's purpose is to study and monitor AI deployment in state government, assess the need for legislative reform and a state code of ethics for government AI use, and study the effects of automated decision systems on residents' rights. The council is composed of seven members appointed by the Governor, President of the Senate, and Speaker of the House, with legislative members serving as co-chairs.
The council must submit quarterly reports to the Governor and Legislature covering findings from agency inventory reports, national AI policy recommendations, an assessment of AI's impact on resident interests, and policy recommendations addressing privacy, discrimination, and AI development promotion.

The term does not include university boards of trustees or state universities. As used in part I of this chapter, except as otherwise specifically provided, the term does not include the Department of Legal Affairs, the Department of Agriculture and Consumer Services, or the Department of Financial Services.Fla. Stat. § 282.0041(5)'s general capabilities, including all of the following: 1. Reasonably foreseeable capabilities outside the scope of the agency's proposed use. 2. Whether the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Any current or potential sources of funding, including any subsidies or free products being offered by vendors or governmental entities.

Stat. § 282.0041(5) inventory report required under this section.
This section requires each state agency to prepare and submit a comprehensive inventory report of all automated decision systems being developed, used, or procured by the agency. Reports must be submitted by July 1, 2025 to the Department of Management Services, the Advisory Council, and relevant legislative standing committees. The inventory must cover system name and vendor, general capabilities including foreseeable out-of-scope uses, independent decision-making capability, data inputs and outputs, bias testing status, purpose and use classification (automated final vs. automated support), intended benefits, data security practices, and fiscal impacts.
The Department of Management Services must prescribe the inventory report form, contents, and submission manner by rule no later than January 1, 2025, in consultation with the Advisory Council. This creates a two-phase obligation: rulemaking first, then agency compliance with the standardized reporting framework.
(1) It is the intent of the Legislature to create a statewide uniform policy regulating the public and private use of artificial intelligence.

This section expresses the Legislature's intent to create a statewide uniform policy on AI regulation and categorically prohibits counties, municipalities, and their political subdivisions from regulating the private or public use of artificial intelligence systems. This is a state preemption provision that prevents local AI regulation — it does not impose affirmative compliance obligations on AI developers or deployers but rather constrains local government regulatory authority.
