(1) The Artificial Intelligence Advisory CouncilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12), an advisory councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) as defined in s. 20.03, is created within the departmentDepartment"Department" means the Department of Management Services.Fla. Stat. § 282.0041(17). Except as otherwise provided in this section, the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall operate in a manner consistent with s. 20.052. The departmentDepartment"Department" means the Department of Management Services.Fla. Stat. § 282.0041(17) shall provide administrative support to the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12). The purpose of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) is to study and monitor the development and deployment of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) in state government. The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall do all of the following: (a) Assess the need for legislative reform and the creation of a state code of ethics for the use of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) in state government. (b) Study and monitor the effects of automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) on the constitutional and legal rights, duties, and privileges of the residents of this state. (c) Study and monitor the potential benefits, liabilities, and risks that the state, private residents, and businesses could incur as a result of implemented automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5). (d) Recommend administrative and legislative actions that state governmental agencies and the Legislature can use to promote the development of artificial intelligence in this state.

(2)(a)–(d) The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall be composed of the following members, whose appointments must be made by October 1, 2024: 1. Two members of the Senate, appointed by the President of the Senate. 2. Two members of the House of Representatives, appointed by the Speaker of the House of Representatives. 3. An academic professional specializing in ethics who is employed by a public or private institution of higher educationPublic or private institution of higher education"Public or private institution of higher education" means: (a) A state university or a Florida College System institution as those terms are defined in s. 1000.21(8) and (5), respectively; or (b) An independent postsecondary educational institution as defined in s. 1005.02.Fla. Stat. § 282.0041(34), appointed by the Governor. 4. An academic professional specializing in artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) who is employed by a public or private institution of higher educationPublic or private institution of higher education"Public or private institution of higher education" means: (a) A state university or a Florida College System institution as those terms are defined in s. 1000.21(8) and (5), respectively; or (b) An independent postsecondary educational institution as defined in s. 1005.02.Fla. Stat. § 282.0041(34), appointed by the Governor. 5. An expert on law enforcement usage of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4), appointed by the Governor. 6. A policy expert, appointed by the Governor. 7. A constitutional and legal rights expert, appointed by the Governor. (b) The members appointed pursuant to subparagraphs (a)1. and 2. shall serve as co-chairs of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12). (c) Each member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall be appointed to a 4-year term; however, for the purpose of providing staggered terms, of the initial appointments, the members appointed pursuant to subparagraphs (a)1. and 2. shall be appointed to 2-year terms, and the other members shall be appointed to 4-year terms. A member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) may be removed at any time by the member's appointing authority, who shall fill the vacancy in the same manner as the original appointment for the remainder of the unexpired term. (d) A member of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) may not receive compensation for serving on the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) but may be reimbursed for per diem and travel expenses in accordance with s. 112.061.

(3) The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall meet no later than November 1, 2024, and monthly thereafter, and at other times upon call of the co-chairs.

(4) 1 The councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) shall submit quarterly reports to the Governor, the President of the Senate, and the Speaker of the House of Representatives. The reports must contain all of the following: (a) A summary of the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12)'s findings after reviewing the automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) inventory reports submitted pursuant to s. 282.321. (b) A summary of the recommendations of any relevant national bodies on use of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) in state government. (c) An assessment of the impact of using artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4) on the liberty, finances, livelihood, and privacy interests of the residents of this state. (d) Recommendations of policies necessary to accomplish all of the following: 1. Protecting the privacy and interests of the residents of this state from any negative effects caused by artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4). 2. Ensuring that the residents of this state are free from unfair discrimination caused or compounded by artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4). 3. Promoting the development and deployment of artificial intelligence in this state. (e) Any other information the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12) considers relevant.

(1) 2 Each state agencyState agency"State agency" means any official, officer, commission, board, authority, council, committee, or department of the executive branch of state government; the Justice Administrative Commission; and the Public Service Commission. The term does not include university boards of trustees or state universities. As used in part I of this chapter, except as otherwise specifically provided, the term does not include the Department of Legal Affairs, the Department of Agriculture and Consumer Services, or the Department of Financial Services.Fla. Stat. § 282.0041(41) shall, using money appropriated to the agency by the Legislature, prepare an inventory report of all automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) that are being developed, used, or procured by the agency. No later than July 1, 2025, each state agencyState agency"State agency" means any official, officer, commission, board, authority, council, committee, or department of the executive branch of state government; the Justice Administrative Commission; and the Public Service Commission. The term does not include university boards of trustees or state universities. As used in part I of this chapter, except as otherwise specifically provided, the term does not include the Department of Legal Affairs, the Department of Agriculture and Consumer Services, or the Department of Financial Services.Fla. Stat. § 282.0041(12), and any standing committee of the Legislature which is responsible for overseeing the state's information technology, and the inventory report must include all of the following: (a) The name and vendor of the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5), if any. (b) The automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5)'s general capabilities, including all of the following: 1. Reasonably foreseeable capabilities outside the scope of the agency's proposed use. 2. Whether the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) is used or may be used for independent decisionmaking powers and the impact or potential impact of those decisions on the residents of this state. (c) The types of data inputs that the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) uses. (d) How the data described by paragraph (c) is or will be generated, collected, and processed. (e) The types of data the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) generates or is reasonably likely to generate. (f) Whether the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) has or has not been tested by an independent third party to determine if it has a known bias or is untested for bias. (g) The purpose and use or proposed use of the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5), including all of the following: 1. The decisions the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) is or will be used to make or support. 2. Whether the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) is an automated final decision systemAutomated final decision system"Automated final decision system" means an automated decision system that makes final decisions, judgments, or conclusions without human intervention.Fla. Stat. § 282.0041(6) or an automated support decision systemAutomated support decision system"Automated support decision system" means an automated decision system that provides information to inform the final decision, judgment, or conclusion of a human decisionmaker.Fla. Stat. § 282.0041(7). 3. The automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5)'s intended benefits, including any data or research relevant to the outcome of those benefits. (h) How automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) data is or will be securely stored and processed, and the reasons the agency does or does not share access to the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) or data from the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) with any other entity. (i) The fiscal impacts of the automated decision systemAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) or potential fiscal impacts on information technology, including all of the following: 1. Initial acquisition costs and ongoing operating costs, such as maintenance, licensing, personnel, legal compliance, use auditing, data retention, and security costs. 2. Any cost savings that have been or will be achieved through the use of the technology. 3. Any current or potential sources of funding, including any subsidies or free products being offered by vendors or governmental entities.

(2) 3 No later than January 1, 2025, the departmentDepartment"Department" means the Department of Management Services.Fla. Stat. § 282.0041(17), in consultation with the councilCouncil"Council" means the Artificial Intelligence Advisory Council created in s. 282.32.Fla. Stat. § 282.0041(12), shall prescribe by rule the form, contents, and manner of submission of the automated decision systemsAutomated decision system"Automated decision system" means an algorithm, including an algorithm incorporating machine learning or other artificial intelligence techniques, that uses data-based analytics to make or support governmental decisions, judgments, or conclusions.Fla. Stat. § 282.0041(5) inventory report required under this section.

(1) It is the intent of the Legislature to create a statewide uniform policy regulating the public and private use of artificial intelligence.

(2) 4 A county or a municipality or any political subdivision thereof may not regulate the private or public use of artificial intelligence systemsArtificial intelligence system"Artificial intelligence system" means a system capable of all of the following: (a) Perceiving an environment through data acquisition and processing and interpreting the derived information to take an action or actions or to imitate intelligent behavior given a specific goal. (b) Learning and adapting behavior by analyzing how the environment is affected by prior actions.Fla. Stat. § 282.0041(4).
