Enforcement Authority
Enforced by the Illinois Attorney General under the Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505). The Act also provides a private right of action for any person who suffers actual damage as a result of a violation. Violations are prosecuted as unlawful practices under the Act.

Penalties

(a) As used in this section: "Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. (b) 1 The owner, licensee, or operator of a generative artificial intelligence systemGenerative artificial intelligence system"Generative artificial intelligence system" means any artificial intelligence system whose primary function is to generate content, including, but not limited to, code, text, and images.815 ILCS 505/2MMMM(a) shall conspicuously display a warning on the system's user interface that is reasonably similar to the following warning: "WARNING: Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2MMMM(a) does not think. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2MMMM(a) can produce fluent, seemingly coherent answers across various topics. Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2MMMM(a) does not understand meaning, have genuine knowledge of the world, or possess communicative intent. Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2MMMM(a) responses are assembled by statistically predicting likely word sequences based on language it has seen before. Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2MMMM(a) can generate confident-sounding responses that contain errors, inaccuracies, or fabricated information."

(c) 1 Each day the warning required under subsection (b) is not displayed by the owner, licensee, or operator of a generative artificial intelligence systemGenerative artificial intelligence system"Generative artificial intelligence system" means any artificial intelligence system whose primary function is to generate content, including, but not limited to, code, text, and images.815 ILCS 505/2MMMM(a) constitutes a separate violation of the Act.

(d) A violation of this Section constitutes an unlawful practice within this meaning of this Act.

This section creates a single core obligation: the owner, licensee, or operator of a generative AI system must conspicuously display a prescribed warning on the system's user interface. The warning is highly prescriptive — the statute provides near-verbatim language explaining that AI does not think, generates responses by statistical pattern prediction, and can produce confident-sounding errors or fabricated information. The standard is "reasonably similar to" the prescribed text, giving operators narrow flexibility in exact wording but not in substance.

Subsection (c) establishes a per-day violation accrual rule: each day the warning is absent constitutes a separate violation, creating significant cumulative exposure. Subsection (d) designates any violation as an unlawful practice under the Consumer Fraud Act, importing the Act's full enforcement apparatus including Attorney General authority and the private right of action.
