(a) As used in this section: "Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligence" includes generative artificial intelligence.815 ILCS 505/2HHHH(a)" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. "Artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs, such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. (b) 1 The owner, licensee, or operator of a generative artificial intelligence systemGenerative artificial intelligence system"Generative artificial intelligence system" means any artificial intelligence system whose primary function is to generate content, including, but not limited to, code, text, and images.815 ILCS 505/2HHHH(a) shall conspicuously display a warning on the system's user interface that is reasonably calculated to consistently apprise the user that the outputs of the generative artificial intelligence systemGenerative artificial intelligence system"Generative artificial intelligence system" means any artificial intelligence system whose primary function is to generate content, including, but not limited to, code, text, and images.815 ILCS 505/2HHHH(a) may be inaccurate or inappropriate.

(c) A violation of this Section constitutes an unlawful practice within the meaning of this Act.

Section 2HHHH creates a single operative obligation: the owner, licensee, or operator of a generative AI system must conspicuously display a warning on the system's user interface alerting users that outputs may be inaccurate or inappropriate. The bill does not prescribe specific warning language — it requires only that the display be conspicuous and reasonably calculated to consistently apprise the user. The statute does not define "owner," "licensee," or "operator" independently; any person who falls into one of those functional roles bears the obligation.

Subsection (c) classifies any violation as an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act, importing the Act's full enforcement framework — including Attorney General enforcement and private causes of action — without creating any new enforcement mechanism.
