(a) "Health careHealth care"Health care" has the meaning set forth in IC 16-36-1-1.IC 16-51-2.5-3", for purposes of IC 16-36-1 and IC 16-51-2.5, has the meaning set forth in IC 16-36-1-1.
This section amends the existing definition of health care in IC 16-18-2-160 to extend its applicability to the new chapter IC 16-51-2.5. The amendment adds a cross-reference so that the definition of health care used in existing IC 16-36-1 also applies to the new AI disclosure obligations imposed on health care providers. No new compliance obligation is created by this section.
(c) "Health care providerHealth care provider"Health care provider" has the meaning set forth in IC 16-18-2-163(c), meaning an individual licensed or authorized by this state to provide health care or professional services as: (1) a licensed physician; (2) a registered nurse; (3) a licensed practical nurse; (4) an advanced practice registered nurse; (5) a certified nurse midwife; (6) a paramedic; (7) an emergency medical technician; (8) an advanced emergency medical technician; (9) an emergency medical responder, as defined by section 109.8 of this chapter; (10) a licensed dentist; (11) a home health aide, as defined by section 174 of this chapter; or (12) a licensed physician assistant. This section amends the existing definition of health care provider in IC 16-18-2-163 to extend subsection (c)'s narrower definition — covering individually licensed professionals — to the new chapter IC 16-51-2.5. This means the AI disclosure obligation in IC 16-51-2.5-5 applies to individual licensed health care professionals (physicians, nurses, dentists, paramedics, etc.) and their employees or agents, rather than the broader institutional definition in subsection (a). No new compliance obligation is created by this section itself.

This new chapter creates the bill's first core obligation: health care providers must disclose to patients when artificial intelligence technology is used to make or inform any decision in the provision of health care, or to generate any part of a communication to the patient regarding their health care, including through a chat bot. The trigger is extremely broad — any AI use in any decision or any part of a communication triggers the disclosure requirement. The chapter does not specify the form, timing, or content of the disclosure, nor does it establish any enforcement mechanism or penalties for noncompliance.

This new chapter mirrors IC 16-51-2.5 but applies to insurers providing accident and sickness coverage. Insurers must disclose to insureds when artificial intelligence technology is used to make or inform any decision involved in the provision of coverage, or to generate any part of a communication to the insured regarding coverage, including through a chat bot. As with the health care provider obligation, the trigger is very broad, the bill does not specify the form or timing of disclosure, and no enforcement mechanism is established.
