This section creates the bill's entire operative framework in four subsections. Subsection A imposes a categorical prohibition on healthcare entities making patient care decisions based solely on AI outputs. Subsection B requires licensed healthcare professionals to review any AI-assisted healthcare decision under board-established procedures and preserves the professional's override authority. Subsection C delegates rulemaking to each professional licensing board. Subsection D provides three definitions — artificial intelligence, healthcare entity, and healthcare professional — that scope the bill's reach broadly across all Title 37 licensed professions and all types of healthcare facilities, organizations, and plans.
The bill is notably silent on enforcement mechanisms, penalties, and remedies, leaving implementation entirely to the licensing boards' existing rulemaking and disciplinary authority.
