Definitions

(1)–(8) § 1710. Definitions. As used in this article: 1. "AIAI"AI" or "artificial intelligence" means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments, abstract such perceptions into models through analysis in an automated manner, and use model inference to formulate options for information or action.Gen. Section 1710 establishes the defined terms for the article. Key defined terms include historically recognized human disaster (an event involving injury to or death of more than ten people, including genocide, war crimes, terrorism, pandemics, and natural disasters), materially deceptive media (AI-created or AI-altered content indistinguishable from reality to a reasonable person that depicts events that did not occur or were significantly altered), and online platform operator (any person operating an internet-based content service with more than one million subscribers). The low threshold for historically recognized human disaster — more than ten people injured or killed — is notably broad, capturing a wide range of events beyond iconic large-scale disasters.

(1)(a) 1 For visual media the disclosure shall be printed or typed in a legible font size easily readable by the average viewer that is no smaller than other text appearing in the visual media and in the same language used on the AI-generated contentAI-generated content"AI-generated content" or "content" means content created by an artificial intelligence model, which can include text, images, audio, and video, produced through algorithms trained on large datasets.Gen. (1)(b) 1 For AI-generated contentAI-generated content"AI-generated content" or "content" means content created by an artificial intelligence model, which can include text, images, audio, and video, produced through algorithms trained on large datasets.Gen. Law § 1710(2) that is auditory, such as radio or automated telephone calls, clearly speaking the statement at the beginning of the audio, at the end of the audio, and, if the audio is greater than two minutes in length, interspersed within the audio at intervals of not greater than two minutes each and in the same language as the rest of the audio used in the communication, and in a pitch that can be easily heard by the average listener satisfies the requirements of this subdivision.

(2) 1 A label as described in subdivision one of this section shall be required when such AI-generated contentAI-generated content"AI-generated content" or "content" means content created by an artificial intelligence model, which can include text, images, audio, and video, produced through algorithms trained on large datasets.Gen. (3)(a)–(d) 1 This section shall not apply to the following: (a) materially deceptive mediaMaterially deceptive media"Materially deceptive media" means any image, video, audio, text, or any technological representation of speech or conduct fully or partially created or modified that: (a) exhibits a high level of authenticity or convincing appearance that is visually or audibly indistinguishable from reality to a reasonable person; (b) depicts a scenario that did not actually occur or that has been altered in a significant way from how they actually occurred; and (c) is created by or with software, machine learning, artificial intelligence, or any other computer-generated or technological means, including adapting, modifying, manipulating, or altering a realistic depiction.Gen. Law § 1710(6) that constitutes satire or parody; (b) materially deceptive mediaMaterially deceptive media"Materially deceptive media" means any image, video, audio, text, or any technological representation of speech or conduct fully or partially created or modified that: (a) exhibits a high level of authenticity or convincing appearance that is visually or audibly indistinguishable from reality to a reasonable person; (b) depicts a scenario that did not actually occur or that has been altered in a significant way from how they actually occurred; and (c) is created by or with software, machine learning, artificial intelligence, or any other computer-generated or technological means, including adapting, modifying, manipulating, or altering a realistic depiction.Gen. Section 1711 imposes the bill's core labeling obligation. Any person who distributes or publishes AI-generated content depicting a historically recognized human disaster that was produced by or includes materially deceptive media must disclose that fact — but only when the person has actual knowledge that the content is materially deceptive. The knowledge requirement is a significant limiting factor: negligence or constructive knowledge is insufficient.

The disclosure must take prescribed forms depending on medium: a legible visual label reading "This (image, video, or audio) has been manipulated" for visual media, and a spoken statement at the beginning, end, and at two-minute intervals for audio content. Subdivision 2 specifies the distribution contexts triggering the obligation: public online posting, social media sharing, advertising or monetized content, and distribution on websites accessible in New York. Four exemptions apply: satire or parody, bona fide news reporting with authenticity disclosures, broadcast stations with consistent disclaimer requirements, and initial dissemination by platforms of content provided by a third-party information content provider.

Section 1712 imposes two distinct obligations on online platform operators. First, operators must provide or allow the use of labeling tools sufficient for users to label materially deceptive media as required under § 1711, and must not lock or otherwise impede use of those tools. Second, operators must not strip AI provenance metadata from any content posted to their platform. The provenance-stripping prohibition is unconditional — it applies regardless of whether the content depicts a historically recognized human disaster.

Gen. Bus. Law § 1713
Enforcement

(1) The attorney general shall have the responsibility for enforcing this article.

(2) Whenever the attorney general shall believe from evidence satisfactory to them that a personPerson"Person" means an individual, proprietorship, firm, partnership, joint venture, syndicate, business trust, company, corporation, limited liability company, association, committee, or any other nongovernmental organization or group of persons acting in concert.Gen. Bus. Law § 1710(8) or platform operator has engaged in or is about to engage in any acts or practices in violation of this article, they may bring an action in the name and on behalf of the people of the state of New York to enjoin such personPerson"Person" means an individual, proprietorship, firm, partnership, joint venture, syndicate, business trust, company, corporation, limited liability company, association, committee, or any other nongovernmental organization or group of persons acting in concert.Gen. Law § 1710(8) or platform operator from continuing such unlawful acts or practices, and may seek civil penalties of up to fifteen thousand dollars per day per violation, and may seek such other remedies as the court may deem appropriate.

(3) All penalties collected under this article shall be deposited into the general fund as established pursuant to section seventy-two of the state finance law.

(4) Nothing in this article shall be construed to establish a private right of action associated with violations of this article.

Section 1713 vests exclusive enforcement authority in the New York Attorney General. The AG may seek injunctive relief, civil penalties of up to $15,000 per day per violation, and other court-ordered remedies. Penalties are deposited into the state general fund. Subdivision 4 explicitly bars any private right of action.

Construction

(1) Nothing in this article shall be construed to limit, or to enlarge, the protections that 47 U.S.C. § 230 confers on an interactive computer service for content provided by another information content providerInformation content provider"Information content provider" means any person or entity that is responsible, in whole or in part, for the creation or development of information provided through the internet or any other interactive computer service.Gen. Bus. Law § 1710(5), as such terms are defined in 47 U.S.C. § 230.

(2) Nothing in this article shall be construed to require entities to cancel, edit, or insert video or audio labels into communications where such action is inconsistent with federal law.

(3) This article does not limit the application of other state or federal laws or of rules or regulations promulgated pursuant to such laws.

Section 1714 contains three savings clauses. The first preserves 47 U.S.C. § 230 protections for interactive computer services regarding third-party content. The second ensures the article does not require entities to take actions inconsistent with federal law. The third confirms the article does not limit other state or federal laws or regulations. These provisions create no new obligations but are important context for understanding the scope of liability under §§ 1711–1712.

Rulemaking authority

The attorney general shall promulgate such rules and regulations as are necessary to effectuate and enforce the provisions of this article.

Section 1715 grants the Attorney General authority to promulgate rules and regulations necessary to effectuate and enforce the article. This delegation may produce additional compliance obligations once regulations are issued, but the section itself creates no direct compliance duty on regulated persons or platforms.

Severability

If any clause, sentence, paragraph, subdivision, section or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. It is hereby declared to be the intent of the legislature that this act would have been enacted even if such invalid provisions had not been included herein.

Standard severability clause declaring legislative intent that the remainder of the article shall survive if any provision is held invalid.
