Definitions

(1)–(17) Section 774. As used in Section 774 et seq. of this title: 1. "Admission ticketAdmission ticket"Admission ticket" means any physical, electronic, or other form of evidence of a right of entry to a venue or an entertainment event for one or more events at a specified date and time;15 O.S. § 774(1)" means any physical, electronic, or other form of evidence of a right of entry to a venue or an entertainment eventEvent"Event" means a concert, theatrical performance, sporting event, exhibition, show, or other similar activity held in this state;15 O.S. § 774(3) for one or more eventsEvent"Event" means a concert, theatrical performance, sporting event, exhibition, show, or other similar activity held in this state;15 O.S. § 774(3) at a specified date and time; 2. Section 774 provides the definitions for the Oklahoma Fraud and Ticketing Accountability Act. The committee substitute significantly expands the original definition section, adding new terms including bot (which encompasses artificial intelligence and software that bypasses security measures or ticket purchase limits), face value, primary ticket seller, resale, reseller, secondary ticket exchange, speculative ticket, sports, and total price. The bot definition is notable because it captures AI tools used to circumvent ticketing controls.

Prohibition on bot use and sale for ticket acquisition

A(1)–(2) 1 Section 774.1. A. B 1 B. The user or seller shall be in violation of subsection A of this section if the user or seller knows or should know that: 1. C C. Any violation of this section shall constitute an unfair or deceptive trade practice and shall be subject to the provisions of the Oklahoma Consumer Protection Act.

Section 774.1 establishes the core prohibitions on using or selling bots and software to circumvent ticket-seller security measures. The section prohibits three categories of conduct: using software or a bot to bypass security or access controls on a ticket seller's website; selling software or a bot advertised for that purpose; and using or creating a bot to purchase tickets, use multiple IP addresses or accounts to exceed ticket limits, or circumvent electronic queues, presale codes, or volume limitations. Liability attaches when the user or seller knows or should know the software's circumvention purpose or that its use led to above-cost resale.

Violations constitute unfair or deceptive trade practices under the Oklahoma Consumer Protection Act, giving the Attorney General enforcement authority alongside the private right of action created in the new § 774.2.

Ticket sale and resale requirements, refund obligations, and prohibited representations

A 3 A. A primary ticket sellerPrimary ticket seller"Primary ticket seller" means a venue, promoter, or provider authorized to sell tickets to the public at the point of initial sale including, but not limited to, public school districts and nonprofit organizations;15 O.S. § 774(9), secondary ticket exchangeSecondary ticket exchange"Secondary ticket exchange" means a marketplace, online platform, or other entity facilitating resale of admission tickets;15 O.S. § 774(13), or resellerReseller"Reseller" means a person or entity that offers or sells an admission ticket after its initial sale;15 O.S. § 774(12) shall clearly and conspicuously disclose at the point of selection: 1. Pursuant to paragraph 1 of this subsection, a nonprofit organization may offer the choice to donate the cost of the admission ticketAdmission ticket"Admission ticket" means any physical, electronic, or other form of evidence of a right of entry to a venue or an entertainment event for one or more events at a specified date and time;15 O.S. § 774(1) to the nonprofit organization, exchange to another performance or eventEvent"Event" means a concert, theatrical performance, sporting event, exhibition, show, or other similar activity held in this state;15 O.S. § 774(3), or receive a refund subject to the terms of the organization's refund policy. 3. The venue shall provide contact information for the Attorney General if the purchaser presents an invalid ticket. 4. Nothing in this subsection shall be construed to alter any rights or obligations under federal payment card laws including, but not limited to, Regulation E of 12 C.F.R., Part 1005.

Use or display, without authorization, the name, mark, logo, likeness, or intellectual property of an artist, venue, or eventEvent"Event" means a concert, theatrical performance, sporting event, exhibition, show, or other similar activity held in this state;15 O.S. § 774(3) organizer in promotional materials, social media, or advertisement; 2. Imply affiliation or endorsement with a venue, team, or artist, including the use of the word "official", unless authorized in writing; or 3. Engage in commercial representations that are reasonably likely to mislead consumers.

E E. Any violation of this act shall constitute an unfair or deceptive trade practice and shall be subject to the provisions of the Oklahoma Consumer Protection Act.

F F. Any aggrieved personPerson"Person" means any individual, partnership, corporation, limited liability company, other organization, or any combination thereof;15 O.S. § 774(6) may bring a civil action for actual damages and restitution. The court may award court costs and attorney fees to a prevailing party.

G G. Nothing in this act shall be construed to include sportsSports"Sports" means any athletic competition, contest, or event in which individuals or teams participate in games, matches, or exhibitions of skill, agility, strength, or endurance whether amateur, collegiate, or professional. Sports shall not mean theatrical, musical, or other live entertainment performances, even if occurring in a sports venue;15 O.S. § 774(15) in the provisions of this act.
