(a) 1 Prohibition.--A law enforcement agencyLaw enforcement agency"Law enforcement agency." As defined in 44 Pa.C.S. § 7202 (relating to definitions).75 Pa.C.S. § 6314(d) may not sell, share, allow access to or transfer automated license plate reader informationAutomated license plate reader information"Automated license plate reader information." (b) 2 Written declaration.--Prior to sharing automated license plate reader informationAutomated license plate reader information"Automated license plate reader information." Information gathered by an automated license plate reader system or created from the analysis of data generated by an automated license plate reader system.75 Pa.C.S. § 6314(d) with a Federal, State or local governmental agency, a law enforcement agencyLaw enforcement agency"Law enforcement agency." As defined in 44 Pa.C.S. § 7202 (relating to definitions).75 Pa.C.S. § 6314(d) must first obtain a written declaration from the Federal, State or local governmental agency that expressly affirms the automated license plate reader informationAutomated license plate reader information"Automated license plate reader information." Information gathered by an automated license plate reader system or created from the analysis of data generated by an automated license plate reader system.75 Pa.C.S. § 6314(d) obtained shall not be used in a manner that violates subsection (a). (c) 3 Confidentiality.--Automated license plate reader informationAutomated license plate reader information"Automated license plate reader information." Information gathered by an automated license plate reader system or created from the analysis of data generated by an automated license plate reader system.75 Pa.C.S. § 6314(d) shall be held confidentially to the fullest extent permitted by law.
(d) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection unless the context clearly indicates otherwise: "Automated license plate reader informationAutomated license plate reader information"Automated license plate reader information." Information gathered by an automated license plate reader system or created from the analysis of data generated by an automated license plate reader system.75 Pa.C.S. § 6314(d)." This section prohibits Pennsylvania law enforcement agencies from sharing automated license plate reader (ALPR) data with any federal, state, or local government agency when the purpose is to investigate or enforce a law that interferes with a person's right to obtain medically accurate information or evidence-based medical services. The prohibition addresses government-to-government data transfers of surveillance technology outputs — not AI system design or deployment.
Before any ALPR data sharing with another government agency, a law enforcement agency must first secure a written declaration from the receiving agency affirming the data will not be used in a prohibited manner. If no declaration is obtained, sharing is blocked entirely. All ALPR data must be held confidentially to the fullest extent permitted by law. The bill does not specify penalties for violations or designate an enforcement authority.
