Section 2 supplies the operative definitions. The scope-defining terms are AI chatbot — generative-AI technology that simulates or engages in interactive conversation, expressly excluding purely scripted, prewritten, or predetermined output — and children's toy, a plaything intended for a child under 14. These two terms together set the reach of the prohibition in Section 3. The definition of artificial intelligence is broad and includes generative AI, but the operative trigger is the narrower AI chatbot term.
(a) 1 Prohibition.--A person may not manufacture, distribute, sell, lease, offer for sale or offer for lease in this Commonwealth a children's toyChildren's toy"Children's toy." A product designed, manufactured, marketed or intended for use as a plaything by a child under 14 years of age.Section 2 that incorporates an AI chatbot.

(c) Notice.--The Attorney General shall transmit notice to the Legislative Reference Bureau for publication in the next available issue of the Pennsylvania Bulletin of the date on which this section no longer applies under subsection (b).
(d) Prior violations.--Subsection (b) shall not affect the authority of the Attorney General to enforce a violation of subsection (a) that occurs before the date on which this section no longer applies.
Section 3 is the operative provision. It bars any person from manufacturing, distributing, selling, leasing, or offering for sale or lease in the Commonwealth a children's toy that incorporates an AI chatbot. The reach spans the entire commercial chain — makers, distributors, and retailers alike.
The prohibition is temporary: it ceases to apply three years after its effective date, with the Attorney General required to publish notice of the sunset date in the Pennsylvania Bulletin. The Attorney General retains authority to pursue violations occurring before the sunset.
(a) Unlawful act or practice.--A violation of section 3 shall be deemed an unfair method of competition and an unfair or deceptive act or practice in the conduct of trade or commerce under section 3 of the Unfair Trade Practices and Consumer Protection LawUnfair Trade Practices and Consumer Protection Law"Unfair Trade Practices and Consumer Protection Law." The act of December 17, 1968 (P.L.1224, No.387), known as the Unfair Trade Practices and Consumer Protection Law.Section 2.

(e) Construction.--The remedies under this section are cumulative and shall not be construed to limit any other remedy available under law.
Section 4 channels all enforcement through the Pennsylvania Attorney General under the Unfair Trade Practices and Consumer Protection Law. A violation of the Section 3 prohibition is deemed an unfair or deceptive act, allowing the Attorney General to seek injunctive relief, costs and restitution, and civil penalties. Remedies are cumulative and do not limit other available remedies. This section creates enforcement machinery rather than a new independent compliance duty.
This act shall take effect immediately.
Section 5 provides that the act takes effect immediately upon enactment. It creates no compliance obligation.
