This section establishes the definitional framework for the part. The 2026 amendment adds a new defined term — artificial intelligence technology — which encompasses any computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses AI or generative AI. This expansion is significant because the prior version of the statute applied only to generative AI; the new term broadens the statute's reach to all AI-powered law enforcement tools, including non-generative systems such as facial recognition, predictive policing platforms, and evidence analysis tools.
(1)(a)–(b) 1 A law enforcement agency shall have a policy concerning the use of generative artificial intelligenceGenerative artificial intelligence"Generative artificial intelligence" means artificial intelligence technology that is capable of creating content such as text, audio, image, or video based on patterns learned from large volumes of data rather than being explicitly programmed with rules.Utah Code § 53-25-901(3) and artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) by employees of the law enforcement agency in the course and scope of the law enforcement agency's work. (2)(a)–(b) 2 A written police report or other law enforcement record that was created wholly or partially by using generative artificial intelligenceGenerative artificial intelligence"Generative artificial intelligence" means artificial intelligence technology that is capable of creating content such as text, audio, image, or video based on patterns learned from large volumes of data rather than being explicitly programmed with rules.Utah Code § 53-25-901(3) or with an artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) shall: (a) contain within the report or record a disclaimer that the report or record contains content generated by artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.Utah Code § 53-25-901(1) or an artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2); and (b) include a certification by the author of the report or record that the author has read and reviewed the report or record for accuracy.
(3)(a)–(c) 3 A law enforcement agency shall publicly post on the law enforcement agency's website: (i) the law enforcement agency's policy described in Subsection (1); and (ii) the information described in Subsection (4). (b) If a law enforcement agency does not have a public website, the law enforcement agency shall post the information described in Subsection (3)(a) on the Utah Public Notice Website created in Section 63A-16-601. (c) A law enforcement agency shall update a public posting required under this section no later than 30 days after the day on which any posted information has changed or is otherwise not current.
(4)(a)–(d) 4 A law enforcement agency shall provide the following information under Subsection (3)(a)(ii): (a) subject to Subsection (5), the artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) that the law enforcement agency uses; (b) for each artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) described in Subsection (4)(a), the artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2)'s available settings that address artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.Utah Code § 53-25-901(1) transparency, content safeguards, or human content oversight or verification, which may include: (i) a setting that requires a minimum level of human editing before a report or other document can be marked as complete; (ii) a setting that includes an acknowledgment on a report or other document that the report or other document was drafted by artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.Utah Code § 53-25-901(1); (iii) a setting that inserts obvious errors into a draft report or other document; and (iv) a setting that limits the types of crimes for which the artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) may be used; (c) for each setting disclosed under Subsection (4)(b), whether the law enforcement agency: (i) requires the use of the setting; (ii) does not use the setting; or (iii) allows an employee to disable, bypass, or turn off the setting; and (d) any other policies the law enforcement agency has that pertain to the use of an artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) described in Subsection (4)(a), (b), or (c).
(5) For purposes of Subsection (4)(a), an artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means a computer system, device, application, software, hardware, algorithm, program, camera system, or similar product that uses artificial intelligence or generative artificial intelligence.Utah Code § 53-25-901(2) does not include technology that uses artificial intelligenceArtificial intelligence"Artificial intelligence" means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.Utah Code § 53-25-901(1) or generative artificial intelligenceGenerative artificial intelligence"Generative artificial intelligence" means artificial intelligence technology that is capable of creating content such as text, audio, image, or video based on patterns learned from large volumes of data rather than being explicitly programmed with rules.Utah Code § 53-25-901(3) for an administrative task that does not materially impact a law enforcement investigation, such as a productivity or document management tool or a technology used to check spelling or grammar.
This section imposes three distinct categories of obligations on law enforcement agencies. First, agencies must adopt and maintain a written policy governing employee use of both generative AI and broader AI technology, covering which tools and settings are authorized, permissible uses and tasks, the importance of human review, and disciplinary consequences for violations. Second, police reports or law enforcement records created wholly or partially using any AI technology must contain a disclaimer identifying AI-generated content and a certification by the author that the report has been reviewed for accuracy.
Third, and most significantly for public transparency, agencies must publicly post their AI policies and detailed information about each AI technology they use — including the technology's available transparency, content safeguard, and human oversight settings — along with whether each setting is required, unused, or employee-disableable. Postings must be updated within 30 days of any change. An exclusion carves out purely administrative AI tools (such as productivity software and spell-checkers) that do not materially impact law enforcement investigations.
