As used in this chapter, unless the context requires a different meaning: "Cloud computing storage serviceCloud computing storage service"Cloud computing storage service" means a service that enables convenient, on-demand network access to a shared pool of configurable computing resources that can be rapidly provisioned and released with minimal management effort or service provider interaction. The definitions narrowly scope the Act's coverage to residential smart speaker and display devices, excluding portable electronics and devices with non-speaker/display primary purposes.

This section contains the Act's core operative requirement: virtual assistant licensees and licensors may not enable voice purchasing on a smart speaker or smart display device unless they first obtain consent from the device's user or a person the user has authorized. The consent standard is exacting — it must be freely given, specific, informed, and unambiguous, and it may not be obtained by signature of a user agreement or as a condition of operating the virtual assistant. This effectively prohibits bundling voice-purchasing consent into standard terms of service or requiring it for basic device functionality.

The delegation mechanism in subsection B allows the user to authorize a third party to consent on the user's behalf, but requires a separate freely given, specific, informed, and unambiguous affirmative statement from the user establishing that delegation.

Exclusions

This chapter shall not be construed to apply to any of the following: 1. Portable electronic devices, including cellular telephones, pagers, watches, headphones, tablets, or laptop computers. 2. This section carves out from the Act's scope several categories of devices: portable electronic devices (phones, tablets, laptops, watches, headphones, pagers), residential electronic devices whose primary purpose is not as a smart speaker or smart display (televisions, kitchen appliances, thermostats, security systems, etc.), motor vehicles, and any other electronic device with an integrated or accessible virtual assistant whose primary purpose is not as a smart speaker or smart display. The exclusions significantly narrow the Act's reach to dedicated smart speaker and smart display products in residential settings.

Enforcement; penalties

Any violation of this chapter shall constitute a prohibited practice under the provisions of § 59.1-200 and shall be subject to any and all of the enforcement provisions of the Virginia Consumer Protection Act (§ 59.1-196 et seq.).

This section establishes that any violation of the Fair Voice Purchasing Act constitutes a prohibited practice under § 59.1-200 and is subject to all enforcement provisions of the Virginia Consumer Protection Act (§ 59.1-196 et seq.). This cross-reference means the Attorney General may bring enforcement actions and individual consumers may pursue private claims for actual damages, injunctive relief, and attorney's fees.

Amendment to prohibited practices list

A(83)/(84) Violating any provision of the Fair Voice PurchasingVoice purchasing"Voice purchasing" means the hands-free verbal activation of a virtual assistant to buy products or services.Va. Code § 59.1-607 Act (§ 59.1-607 et seq.).

This section amends Virginia's enumerated list of prohibited consumer practices in § 59.1-200 to add a new item (numbered 83 in the pre-July 1, 2025 version and 84 in the post-July 1, 2025 version) declaring that violating any provision of the Fair Voice Purchasing Act (§ 59.1-607 et seq.) constitutes a prohibited practice. This cross-listing is the statutory mechanism that subjects Fair Voice Purchasing Act violations to the full enforcement apparatus of the Virginia Consumer Protection Act.
