Enforcement Authority
Attorney General has exclusive enforcement authority. May issue civil investigative demands and bring actions in circuit court for injunctive relief and civil penalties. No private right of action.

No private right of action. Enforcement is exclusive to the designated authority.
Penalties
Civil penalty not to exceed $1,000 per violation plus reasonable attorney fees, expenses, and court costs. Willful violations carry a minimum of $1,000 and maximum of $10,000 per violation plus attorney fees, expenses, and court costs. Each violation constitutes a separate violation. Injunctive relief available without proof of damages. Civil penalties paid into the Literary Fund.

Definitions

As used in this chapter, unless the context requires a different meaning: "Algorithmic discriminationAlgorithmic discrimination"Algorithmic discrimination" means any discrimination that is (i) prohibited under state or federal law and (ii) a reasonably foreseeable consequence of deploying or using a high-risk artificial intelligence system to make a consequential decision.Va. Section 59.1-603 establishes the definitional foundation for the chapter. The key gating definition is high-risk artificial intelligence system, which is narrowed by four carve-outs for narrow procedural tasks, post-hoc human activity improvement, pattern-detection tools subject to human review, and preparatory assessment tasks. Consequential decision scopes the chapter to decisions with material legal or similarly significant effects across seven enumerated domains. The section also defines terms for generative AI, foundation models, and significant updates, though the chapter's operative obligations are limited to high-risk systems making consequential decisions.

Developer

(A) 1 No developer of a high-risk artificial intelligence systemHigh-risk artificial intelligence system"High-risk artificial intelligence system" means any artificial intelligence system that is specifically intended to autonomously make, or be a controlling factor in making, a consequential decision. A system or service is not a "high-risk artificial intelligence system" if it is intended to (i) perform a narrow procedural task, (ii) improve the result of a previously completed human activity, (iii) detect decision-making patterns or deviations from prior decision-making patterns and is not meant to replace or influence the previously completed human assessment without proper human review, or (iv) perform a preparatory task to an assessment relevant to a consequential decision.Va. (B) 2 Each developerDeveloper"Developer" means any person doing business in the Commonwealth that develops or intentionally and substantially modifies a high-risk artificial intelligence system that is offered, sold, leased, given, or otherwise provided to consumers in the Commonwealth.Va. (D) High-risk artificial intelligence systemsHigh-risk artificial intelligence system"High-risk artificial intelligence system" means any artificial intelligence system that is specifically intended to autonomously make, or be a controlling factor in making, a consequential decision. A system or service is not a "high-risk artificial intelligence system" if it is intended to (i) perform a narrow procedural task, (ii) improve the result of a previously completed human activity, (iii) detect decision-making patterns or deviations from prior decision-making patterns and is not meant to replace or influence the previously completed human assessment without proper human review, or (iv) perform a preparatory task to an assessment relevant to a consequential decision.Va. Code § 59.1-603 that are in conformity with artificial intelligenceArtificial intelligence"Artificial intelligence" means technology that uses data to train statistical models for the purpose of enabling a computer system or service to autonomously perform any task, including visual perception, natural language processing, and speech recognition, that is normally associated with human intelligence or perception.Va. Section 59.1-604 establishes two distinct developer obligations. First, developers must provide deployers with a statement of intended uses and detailed documentation covering known limitations, algorithmic discrimination risks, performance evaluation summaries, mitigation measures, and human oversight instructions before making a high-risk AI system available. Second, developers must provide deployers with information reasonably required to complete an impact assessment. A trade-secret safe harbor in subsection (C) protects confidential and proprietary information from compelled disclosure. Subsection (D) creates a standards-conformity presumption — high-risk AI systems conforming to recognized AI standards are presumed compliant with the section's requirements.

Section 59.1-605 imposes the bill's core deployer obligations across five subsections. Subsection (A) establishes a general duty to avoid reasonably foreseeable algorithmic discrimination. Subsection (B) requires deployers to design and implement a risk management policy and program at least as stringent as the NIST AI RMF, calibrated to the deployer's size, system sensitivity, data volume, and implementation cost. Subsection (C) requires pre-deployment and post-update impact assessments with six enumerated minimum content elements, plus record retention. Subsection (D) requires individual notification when a high-risk AI system is used to make a consequential decision. Subsection (E) requires publication of a summary describing how the deployer manages algorithmic discrimination risk. A standards-conformity presumption and cross-compliance safe harbor apply to the impact assessment requirement.

(D) Nothing this chapter shall be construed to impose any obligation on a developerDeveloper"Developer" means any person doing business in the Commonwealth that develops or intentionally and substantially modifies a high-risk artificial intelligence system that is offered, sold, leased, given, or otherwise provided to consumers in the Commonwealth.Va. Code § 59.1-603 or deployerDeployer"Deployer" means any person doing business in the Commonwealth that deploys or uses a high-risk artificial intelligence system to make a consequential decision.Va. Code § 59.1-603 that adversely affects the rights or freedoms of any person, including the rights of any person to freedom of speech or freedom of the press guaranteed in the First Amendment to the Constitution of the United States or under the Virginia Human Rights Act (§ 2.2-3900 et seq.).

(E) If a developerDeveloper"Developer" means any person doing business in the Commonwealth that develops or intentionally and substantially modifies a high-risk artificial intelligence system that is offered, sold, leased, given, or otherwise provided to consumers in the Commonwealth.Va. Code § 59.1-603 or deployerDeployer"Deployer" means any person doing business in the Commonwealth that deploys or uses a high-risk artificial intelligence system to make a consequential decision.Va. Code § 59.1-603 engages in any action pursuant to an exemption set forth in this section, the developerDeveloper"Developer" means any person doing business in the Commonwealth that develops or intentionally and substantially modifies a high-risk artificial intelligence system that is offered, sold, leased, given, or otherwise provided to consumers in the Commonwealth.Va. Code § 59.1-603 or deployerDeployer"Deployer" means any person doing business in the Commonwealth that deploys or uses a high-risk artificial intelligence system to make a consequential decision.Va. Code § 59.1-603 bears the burden of demonstrating that such action qualifies for such exemption.

Section 59.1-606 establishes broad exemptions for developers and deployers. Subsection (A) carves out twelve categories of activity — including compliance with law, law enforcement cooperation, legal claims, consumer-requested services, security operations, IRB-approved research, and public health actions — from the chapter's obligations. Subsection (B) separately exempts internal research, product recalls, technical error correction, and operations reasonably aligned with consumer expectations. Subsection (C) preserves evidentiary privileges. Subsection (D) includes a First Amendment and Virginia Human Rights Act savings clause. Notably, subsection (E) places the burden of proving applicability of any exemption on the developer or deployer invoking it.

Enforcement; civil penalty
DeployerDeveloper

(A) The Attorney General shall have exclusive authority to enforce the provisions of this chapter.

(B) Whenever the Attorney General has reasonable cause to believe that any person has engaged in or is engaging in any violation of this chapter, the Attorney General is empowered to issue a civil investigative demand. The provisions of § 59.1-9.10 shall apply mutatis mutandis to civil investigative demands issued pursuant to this section.

(C) Notwithstanding any contrary provision of law, the Attorney General may cause an action to be brought in the appropriate circuit court in the name of the Commonwealth to enjoin any violation of this chapter. The circuit court having jurisdiction may enjoin such violation notwithstanding the existence of an adequate remedy at law. In any action brought pursuant to this section, it shall not be necessary that damages be proved.

(D)–(E) Any person who violates the provisions of this chapter shall be subject to a civil penalty in an amount not to exceed $1,000 plus reasonable attorney fees, expenses, and court costs, as determined by the court. Any person who willfully violates the provisions of this chapter shall be subject to a civil penalty in amount not less than $1,000 and not more than $10,000 plus reasonable attorney fees, expenses, and court costs, as determined by the court. Such civil penalties shall be paid into the Literary Fund. Each violation of this chapter shall constitute a separate violation and shall be subject to any civil penalties imposed under this section.

(F) 8 The Attorney General may require that a developerDeveloper"Developer" means any person doing business in the Commonwealth that develops or intentionally and substantially modifies a high-risk artificial intelligence system that is offered, sold, leased, given, or otherwise provided to consumers in the Commonwealth.Va. Code § 59.1-603 disclose to the Attorney General any statement or documentation described in this chapter if such statement or documentation is relevant to an investigation conducted by the Attorney General. Section 59.1-607 vests exclusive enforcement authority in the Attorney General. The AG may issue civil investigative demands under the existing § 59.1-9.10 framework, bring circuit court actions for injunctive relief without proof of damages, and impose per-violation civil penalties up to $1,000 (or $1,000–$10,000 for willful violations) plus attorney fees and court costs. Subsection (F) separately authorizes the AG to compel production of developer documentation and deployer risk management policies, impact assessments, and records during investigations.
