This section creates Idaho's FAIR Elections Act, establishing a candidate-initiated private right of action against deceptive use of AI-generated synthetic media in electioneering communications. The core prohibition is enforced through civil litigation — there is no administrative enforcement mechanism. A candidate may seek both injunctive relief to stop publication and monetary damages (general and special) against the information content provider.
The statute provides an affirmative defense when synthetic media carries a prominent disclosure stating "This (video/audio) has been manipulated," with format-specific requirements for video and audio. Liability is directed at information content providers rather than disseminating media, except where the medium removes a disclosure or itself alters content to create synthetic media. Interactive computer services receive protection modeled on CDA § 230 unless they fall within the medium-liability exceptions. The plaintiff bears a heightened clear-and-convincing-evidence burden.
