(A)(1)–(9) A. Subsection A establishes nine defined terms that collectively frame the scope of the surveillance-based price discrimination prohibition. The definitions are notably broad: surveillance data encompasses any data obtained through observation, inference, or surveillance related to personal characteristics, behaviors, or biometrics — including purchased or acquired data. Behaviors sweeps in web browsing history, IP addresses, locations, purchase history, financial circumstances, and group-level inferences. Price extends beyond the sticker price to all related costs, fees, and material terms bearing on the amount paid or the value received.
The bill does not define the operative phrase "surveillance-based price discrimination" itself, leaving that concept to be constructed from the interplay of these component definitions.

B(3) 1 An entity or person has not engaged in surveillance-based pricePrice"Price" means the amount charged to a consumer in relation to a transaction, including all related costs and fees and other material terms of the transaction that have a direct bearing on the amount paid by the consumer or the value of the good or service offered or provided to the consumer.R.S. 51:1430(A)(8) discrimination if the person can demonstrate that a refusal to extend credit at specific terms or the refusal to enter into a transaction with a specific consumerConsumer"Consumer" means an individual who uses, purchases, or leases goods or services.R.S. 51:1430(A)(4) is based on data provided in a consumerConsumer"Consumer" means an individual who uses, purchases, or leases goods or services.R.S. 51:1430(A)(4) report pursuant to the Fair Credit Reporting Act, 15 U.S.C. 1681 et seq.
Subsection B contains the bill's core prohibition and its structured exceptions. Paragraph (1) establishes a flat prohibition: no person shall engage in surveillance-based price discrimination. Because the bill does not define the composite term, the prohibition's scope must be read through the defined components — it prohibits using surveillance data (data related to personal characteristics, behaviors, or biometrics obtained through observation, inference, or surveillance) to set individualized prices.
Paragraphs (2) and (3) carve out several categories of differential pricing that do not constitute a violation. Cost-justified differentials are excepted outright. Discount programs are excepted only if they satisfy all of a multi-factor test: public terms, uniform membership application, no secondary use of surveillance data, voluntary consumer provision of data, and no differential loyalty-point pricing. Insurers are excepted if they limit automated decision system inputs to risk-relevant data for policy pricing. Credit decisions based on consumer reports under the Fair Credit Reporting Act are also excepted. These exceptions function as affirmative defenses — the person must demonstrate the applicability of the exception.
C A violation of this Section shall be a deceptive and unfair trade practice and subject the violator to any action and penalty provided for in this Chapter, including a private right of action as provided in R.S. 51:1409.
Subsection C classifies a violation of the surveillance-based price discrimination prohibition as a deceptive and unfair trade practice under Louisiana's Unfair Trade Practices and Consumer Protection Law (R.S. 51:1401 et seq.), thereby importing the full enforcement apparatus of that chapter. This includes enforcement by the Attorney General, civil penalties, and — critically — a private right of action under R.S. 51:1409, which permits consumers to recover actual damages, attorney's fees, and up to treble damages for knowing violations.
