Subdivision 1 establishes the definitions governing the bill's prohibitions on surveillance-based price and wage discrimination. The key defined terms are automated decision system, surveillance data, and surveillance-based price discrimination and surveillance-based wage discrimination. Notably, the definition of individualized extends beyond data specific to a single person to include inferences about a group, band, class, or tier of individuals sharing particular characteristics — meaning group-level profiling that results in differential pricing or wages is also covered. The definition of surveillance data is extremely broad, encompassing any data obtained through observation, inference, or surveillance related to personal characteristics, behaviors, or biometrics, including purchased data.

Subdivision 2 establishes the core prohibition against surveillance-based price discrimination — no person may use an automated decision system to set individualized consumer prices based on surveillance data. The prohibition is broad: surveillance data covers personal characteristics, behaviors, and biometrics obtained through observation, inference, or surveillance, and individualized includes group-level profiling.
Three affirmative defenses are available: (1) price differentials justified by actual cost differences in serving different consumers; (2) publicly available group discounts (e.g., military, senior, student) offered on equal terms consistent with antidiscrimination law; and (3) insurers that input only risk-relevant data into pricing systems. A separate safe harbor applies to credit decisions based on FCRA-covered consumer reports. The burden is on the person to demonstrate the defense applies.

Subdivision 3 establishes the parallel prohibition against surveillance-based wage discrimination — no person may use an automated decision system to set individualized worker wages based on surveillance data. Wage is defined broadly to include hourly rates, salaries, bonuses, commissions, scheduling, and task assignment — any material term with a direct impact on earnings.
The affirmative defense is narrower than for price discrimination: the person must show both that wages are based solely on task-specific worker data or cost-of-labor differences, and that the person disclosed in plain language before hiring what data is considered and how the automated decision system uses it. A carve-out provides that declining to hire an individual who has not previously worked for the person is not surveillance-based wage discrimination.

Subdivision 4 imposes a procedural transparency obligation on any person that uses an automated decision system for pricing or wage decisions. Three categories of procedures must be developed and published: (1) procedures to ensure data accuracy; (2) procedures allowing consumers or workers to correct or challenge data accuracy; and (3) procedures for consumers or workers to request and receive information about what data is considered and how the system uses it. This subdivision applies to all users of automated pricing or wage-setting systems, not only those engaging in prohibited surveillance-based discrimination — it is a standalone procedural requirement triggered by use of automated decision-making for prices or wages.
