Subdivision 1 establishes the defined terms for the section. The key definitional choice is the breadth of recommendation feature, which captures any engagement-metric-driven content targeting — encompassing views, dwell time, clicks, likes, shares, purchases, and any other proxy for user engagement. The social media platform definition carves out search engines, ISPs, email, SMS, streaming services with only incidental interactive features, and internal business communication tools.

Subdivision 2 contains the bill's two core operative obligations. Paragraph (a) prohibits covered social media platforms — those with more than 1,000,000 global account holders operating in Minnesota — from using social media algorithms to target user-generated content at Minnesota-based account holders under 18. The prohibition is sweeping but includes three safe harbors: chronological content display, chronological display of content the minor has selected or followed, and search results responsive to a user-initiated query. These carve-outs permit reverse-chronological feeds and user-directed browsing while banning engagement-optimized algorithmic recommendation.

Paragraph (b) imposes a separate parental-consent gate: covered platforms must obtain verifiable parental consent before a minor in Minnesota may open a new account. The statute does not define what constitutes verifiable parental consent, leaving compliance standards open to interpretation.

Subdivision 3 carves out four categories from the prohibition: parental control tools or age-appropriate content filters; internal platform controls designed to restrict minor access or filter content; user-generated content created by federal, state, or local governments; and educational content created by schools, colleges, or universities (including associated software, communication services, or learning management systems under institutional supervision). These exceptions ensure that safety-oriented filtering and institutional educational content are not inadvertently caught by the algorithmic targeting ban.

subd. 5 This section may be cited as the "Stop Online Targeting Against Kids Act" or "SOTA Kids Act."

EFFECTIVE DATE. This section is effective January 1, 2026.

Subdivision 5 provides the bill's short title — the Stop Online Targeting Against Kids Act (SOTA Kids Act) — and the effective date provision sets the operative date as January 1, 2026.
