Subdivision 1 establishes the definitional framework for the bill. The key concept is surveillance data — data obtained through observation, inference, or surveillance of a consumer or worker that relates to personal characteristics, behaviors, or biometrics. The bill then defines the two prohibited practices — surveillance-based price discrimination and surveillance-based wage discrimination — as using an automated decision system to set individualized prices or wages based on such surveillance data. The definition of automated decision system is broad, encompassing any computation-based system used to assist or replace human decision-making, explicitly including machine learning and AI techniques while excluding passive computing infrastructure.

Subdivision 2 establishes the bill's first core prohibition: no person may engage in surveillance-based price discrimination — i.e., use an automated decision system to set individualized prices based on surveillance data about a consumer. The prohibition is broad but subject to three affirmative defenses: cost-justified differentials, publicly available group discounts consistent with antidiscrimination law, and insurer use of risk-relevant-only data. A separate safe harbor applies to credit decisions based on data from consumer reports covered by the federal Fair Credit Reporting Act.

Subdivision 3 establishes the bill's second core prohibition: no person may engage in surveillance-based wage discrimination — using an automated decision system to set individualized wages based on surveillance data about a worker. The affirmative defense structure differs from the price-discrimination prohibition: a person must show both that individualized wages are based solely on task-specific or cost-specific data and that the person disclosed in plain language before hiring what data the automated decision system considers and how. A carve-out excludes refusal-to-hire decisions for individuals who have not previously worked for the person.

Subdivision 4 imposes an affirmative procedural obligation on any person that uses an automated decision system for wage or price decisions. Such persons must develop and publish reasonable procedures addressing three areas: ensuring the accuracy of all data the system considers, allowing consumers or workers to correct or challenge that data, and enabling consumers or workers to request information about what data the system uses and how it uses it. This subdivision applies independently of whether the entity's pricing or wage-setting practices would violate the substantive prohibitions in subdivisions 2 and 3 — it applies to any use of an automated decision system for these purposes.
