(1)–(8) § 1700. Definitions. As used in this article, the following terms shall have the following meanings: 1. Section 1700 establishes the defined terms for Article 47. The key definitions are AI companion — a system that uses AI, generative AI, and/or emotional recognition algorithms to simulate social human interaction by retaining prior interaction data and engaging in personalized conversation on matters of personal well-being — and Operator, which sweeps broadly to include any person, partnership, association, firm, or business entity (and affiliates, subsidiaries, and beneficial owners) that operates or provides an AI companion.
The AI companion definition includes an express carve-out for customer-service chatbots used solely to provide information about commercial services, products, or account information. The definition of emotional recognition algorithms is notably detailed, covering text-based sentiment analysis, voice emotion AI, and facial/gait/physiological video analysis.
1 § 1701. Prohibitions and requirements. Section 1701 establishes the bill's core safety prerequisite: it is unlawful for an operator to operate or provide an AI companion unless the AI companion contains a protocol addressing three categories of user-expressed harm — suicidal ideation or self-harm, physical harm to others, and financial harm to others. The protocol must include, at minimum, a notification referring users to crisis service providers such as a suicide hotline, crisis text line, or other appropriate crisis services.
This is framed as a continuous operating prerequisite — the operator may not lawfully offer the AI companion at any time without the protocol in place. The inclusion of financial harm to others is unusual; most comparable state companion-chatbot bills (e.g., CA SB 243) limit crisis protocols to suicidal ideation and self-harm. The bill does not require public posting of the protocol on the operator's website, nor does it require annual reporting to any state authority — both features present in CA SB 243.
2 § 1702. Notifications. "AI companion" shall not include any system used by a business entity solely intended to provide users with information about available commercial services or products, customer account information, or other information related to a user's customer, or potential customer, relationship with such business entity.Gen. "AI companion" shall not include any system used by a business entity solely intended to provide users with information about available commercial services or products, customer account information, or other information related to a user's customer, or potential customer, relationship with such business entity.Gen. Bus. Section 1702 requires operators to provide a mandatory notification to users both at the beginning of any AI companion interaction and at least every three hours during continuing interactions. The notification must state — verbally or in bold, capitalized letters of at least sixteen-point type — that the AI companion is a computer program and not a human being, and that it is unable to feel human emotion.
Unlike CA SB 243, which conditions its primary AI-identity disclosure on a reasonable-person-misled standard (with an unconditional rule only for known minors), NY AB 6767 imposes this disclosure unconditionally for all users at both the initial and periodic intervals. The bill also mandates specific language ("THE AI COMPANION … IS A COMPUTER PROGRAM AND NOT A HUMAN BEING. IT IS UNABLE TO FEEL HUMAN EMOTION") and specifies formatting requirements (bold, capitalized, at least 16-point type) — a prescriptiveness not seen in most comparable bills.
3 § 1703. Enforcement. Any personPerson"Person" means any natural person.Gen. Bus. Law § 1700(6) who was physically injured through self-harm or was physically or financially harmed by another as a result of a violation of section seventeen hundred one or seventeen hundred two of this article may bring an action in a court of competent jurisdiction for damages, equitable relief, and such other remedies as the court may deem appropriate.
Section 1703 creates a private right of action for persons physically injured through self-harm or physically or financially harmed by another as a result of a violation of sections 1701 or 1702. Available remedies are damages, equitable relief, and such other remedies as the court may deem appropriate. There is no designated agency enforcer, no statutory minimum or maximum damages, and no provision for attorney's fees.
The standing requirement is notably narrow: the plaintiff must have been physically injured through self-harm or physically or financially harmed by another. Emotional or psychological harm alone does not appear to confer standing. This is a significant practical limitation compared to CA SB 243, which requires only "injury in fact" and provides a $1,000 statutory minimum per violation.
§ 1704. Severability. If any clause, sentence, paragraph, subdivision, section or part of this act shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. It is hereby declared to be the intent of the legislature that this act would have been enacted even if such invalid provisions had not been included herein.
Section 1704 is a standard severability clause declaring that if any provision of the act is adjudged invalid, the remainder continues in effect. It further states that the legislature would have enacted the act even without the invalid provisions.
