(5) 1 Any political communication, whether made by phone call, email or other message-based communication, that utilizes an artificial intelligence system to engage in human-like conversation with another shall, by reasonable means, apprise the person of the fact that they are communicating with an artificial intelligence system.
This new subdivision adds a single obligation to the existing political communication framework of Election Law § 14-106: any political communication that uses an AI system to engage in human-like conversation must inform the recipient of the AI's involvement. The duty is framed broadly — it applies across phone calls, email, and other message-based communications — and the compliance standard is flexible: disclosure must be made "by reasonable means." The bill does not define what constitutes an artificial intelligence system, a political communication, or reasonable means, leaving those terms to existing statutory context and enforcement interpretation.
This act shall take effect immediately.
