This act shall be known and may be cited as the Artificial IntelligenceArtificial intelligence(1) A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations or decisions influencing real or virtual environments, including the ability to: (i) perceive real and virtual environments; (ii) abstract perceptions made into models through analysis in an automated manner; and (iii) use model inference to formulate options for information or action based on outcomes under this paragraph. The following words and phrases when used in this act shall have the meanings given to them in this section unless the context clearly indicates otherwise: "Artificial intelligenceArtificial intelligence(1) A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations or decisions influencing real or virtual environments, including the ability to: (i) perceive real and virtual environments; (ii) abstract perceptions made into models through analysis in an automated manner; and (iii) use model inference to formulate options for information or action based on outcomes under this paragraph. Defines the operative terms for the Act. The definition of artificial intelligence tracks the OECD/NIST formulation and expressly includes generative artificial intelligence. The political advertisement definition is unusually broad, sweeping in not only electoral advertising but also issue advocacy on any 'controversial issue of public importance,' across a wide range of media — television, radio, digital, mailings, telephone, robocall, text, websites, and apps.
These definitions are scope-setting; they impose no standalone compliance duty.

This is the core operative section. Any political advertisement containing footage or audio generated in whole or in part with artificial intelligence must carry a clear and conspicuous statement that AI was used, including the date, time, and origin of the content. The mechanics vary by format: print or text/graphic ads must display the statement so it is easily seen and read, while audio-visual and audio-only ads must broadcast it as an audio tagline at the beginning of the advertisement.
Because the duty attaches to the act of publishing AI-generated political content, the obligation runs to the publisher of the advertisement rather than to any developer or platform.
(a) Action.--A person who is adversely affected by the use of artificial intelligenceArtificial intelligence(1) A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations or decisions influencing real or virtual environments, including the ability to: (i) perceive real and virtual environments; (ii) abstract perceptions made into models through analysis in an automated manner; and (iii) use model inference to formulate options for information or action based on outcomes under this paragraph. (2) The term includes generative artificial intelligence.Section 2 in a political advertisementPolitical advertisementAn advertisement for the purpose of influencing public opinion with respect to a legislative, public policy, administrative or electoral matter or a controversial issue of public importance in order to influence the outcome of an election by means of an audio-visual advertisement, a print advertisement, mailings, telephone calls, publicly accessible Internet website, digital device, application or advertising platform.Section 2 that does not contain the disclosure required under section 3 may bring an action in the appropriate court for declaratory or injunctive relief and actual damages.
(b) Civil action.--The Attorney General, appropriate district attorney or person identified under subsection (a) may bring a civil action for violations of this act.
(c) Damages.--A court of competent jurisdiction may award damages for a violation of this act. The court may award: (1) A civil fine that does not exceed $3,000. (2) Actual attorney fees and court costs. (3) Other legal and equitable relief as the court deems appropriate.
Provides the enforcement framework for the disclosure mandate. A person adversely affected by an undisclosed AI political advertisement may sue for declaratory or injunctive relief and actual damages, and the Attorney General, the appropriate district attorney, or such a person may bring a civil action. Available remedies include a civil fine of up to $3,000, actual attorney fees and court costs, and other legal and equitable relief.
This section is an enforcement hook for the Section 3 obligation and imposes no independent affirmative compliance duty.
The provisions of this act shall not apply to a political advertisementPolitical advertisementAn advertisement for the purpose of influencing public opinion with respect to a legislative, public policy, administrative or electoral matter or a controversial issue of public importance in order to influence the outcome of an election by means of an audio-visual advertisement, a print advertisement, mailings, telephone calls, publicly accessible Internet website, digital device, application or advertising platform.Section 2 that was printed, broadcast, manufactured or produced before the effective date of this section.
Limits the Act's reach prospectively: it does not apply to any political advertisement printed, broadcast, manufactured, or produced before the effective date. This is a scope limitation, not a compliance duty.
This act shall take effect in 30 days.
The Act takes effect 30 days after enactment. No compliance obligation arises from this section.
