Enforcement Authority
Private right of action only. An eligible plaintiff — including the right holder, a parent or guardian of a minor subject, an exclusive licensee, or a person controlling postmortem rights — may bring a civil action for injunctive relief or damages. No designated agency enforcer. An online service provider that fails to remove an unauthorized digital replica after receiving a compliant notification may be presumed to have acted knowingly. Three-year statute of limitations from discovery.

Penalties
Statutory damages of $5,000 per work (individual violator), $5,000 per violation (online service provider), or $25,000 per work (other entity violator), or actual damages plus profits, whichever is greater. Punitive damages available for wilful violations involving malice, fraud, knowledge, or wilful avoidance. Online service providers with an objectively reasonable belief the material is not a digital replica face a $1,000,000 damages cap. Prevailing plaintiffs shall receive reasonable attorney's fees; prevailing defendants receive fees only if the action was not brought in good faith. For false or deceptive takedown notices, liability is the greater of $5,000 or actual damages plus court costs and attorney's fees.

Definitions

(1)–(10) Sec. 651.001. DEFINITIONS. In this chapter: (1) "Digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Section 115(e).Bus. & Com. Code § 651.001(6)" means: (A) any publicly accessible Internet website, online application, mobile application, or virtual reality environment, including a social media service, social media network, or online application store, that predominantly provides a community forum for user-generated content, including the sharing of videos, images, games, audio files, or other material; and (B) a digital music provider, as defined by 17 U.S.C. Section 115(e). (7) "Online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7)" means the owner of an online serviceOnline service"Online service" means: (A) any publicly accessible Internet website, online application, mobile application, or virtual reality environment, including a social media service, social media network, or online application store, that predominantly provides a community forum for user-generated content, including the sharing of videos, images, games, audio files, or other material; and (B) a digital music provider, as defined by 17 U.S.C. Section 115(e).Bus. & Com. Code § 651.001(6). (8) "ProductionProduction"Production" means the creation of a digital replica.Bus. & Com. Section 651.001 establishes the definitional framework for the chapter. The key defined term is digital replica — a newly created, computer-generated, highly realistic electronic representation readily identifiable as a specific individual's voice or visual likeness. The definition excludes traditional production techniques such as sampling, remixing, and remastering authorized by the copyright holder. The section also defines right holder broadly to include both the depicted individual and any successor who acquires the authorization right through license, inheritance, or otherwise.

Applicability — Texas residents only

Sec. 651.002. APPLICABILITY. This chapter applies only to an individualIndividual"Individual" means a natural or deceased person.Bus. & Com. Code § 651.001(4) who: (1) is a resident of this state; or (2) was a resident of this state on the date the individualIndividual"Individual" means a natural or deceased person.Bus. & Com. Code § 651.001(4) died.

Section 651.002 limits the chapter's applicability to individuals who are Texas residents or who were Texas residents at the time of death. This is a jurisdictional scope provision rather than an obligation-creating section.

Unauthorized use of digital replica

UNAUTHORIZED USE OF DIGITAL REPLICADigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Section 651.053 is the core prohibition: no person may produce, publish, reproduce, display, distribute, transmit, or otherwise make available a digital replica without the right holder's written consent. The prohibition is subject to the permitted-use exceptions in Section 651.054 and the manufacturer/distributor safe harbor in Section 651.104. This is a broad consent-gating obligation applicable to any person — not limited to commercial entities — that creates or distributes AI-generated voice or visual likeness content.

Code § 651.001(1) is the subject of, or is materially relevant to, the subject of the broadcast or account; (2) a representation of the individualIndividual"Individual" means a natural or deceased person.Bus. & Com. Code § 651.001(8) or use of that digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) is embodied in a musical sound recording that is synchronized to accompany a motion picture or other audiovisual work, except to the extent that the use of that digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) is protected by the First Amendment to the United States Constitution; (3) produced or used consistent with the public interest in bona fide commentary, criticism, scholarship, satire, or parody; (4) used in a fleeting or negligible manner; or (5) used in an advertisement or commercial announcement for a purpose described by Subdivisions (1) through (4) and the digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) is relevant to the subject of the advertisement or announcement.

(b) Subsection (a) does not apply to a digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) used to depict sexual conduct, as defined by Section 21.16, Penal Code.

Section 651.054 carves out categories of digital replica use that do not require right-holder consent: bona fide news, public affairs, or sports broadcasts; documentary, biographical, or historical representations (unless they create a false impression of authenticity or involve a musical sound recording synchronized to a motion picture); commentary, criticism, scholarship, satire, or parody; fleeting or negligible uses; and advertisements for those permitted purposes. Critically, subsection (b) removes all permitted-use protections for digital replicas depicting sexual conduct — meaning NCII-type content can never be shielded by these exceptions.

Except as provided by Section 651.056 or 651.057, an individualIndividual"Individual" means a natural or deceased person.Bus. & Com. Section 651.055 establishes formal validity requirements for licenses of digital replication rights during an individual's lifetime. A license is valid only if it (1) does not exceed 10 years, (2) is in writing and signed by the individual or authorized representative, and (3) includes a reasonably specific description of intended uses. These requirements function as mandatory contracting terms that any licensee must satisfy to hold a valid license.

Section 651.056 imposes heightened licensing requirements when the individual whose likeness is being licensed is a minor. These protections ensure judicial oversight of commercial exploitation of a minor's digital likeness.

Section 651.057 provides that the licensing formality requirements of Sections 651.055 and 651.056 do not apply when the license is governed by a collective bargaining agreement that addresses digital replicas. This carve-out preserves the primacy of union-negotiated terms in the entertainment industry context.

Section 651.051 establishes the digital replication right as a recognized property right. The right is licensable (wholly or partly, exclusively or nonexclusively) but is not assignable during the individual's lifetime. This provision creates the legal foundation for all other obligations in the chapter but does not itself impose compliance duties on third parties.

Section 651.052 governs the postmortem duration and transferability of digital replication rights. The right does not expire on death and is transferable by will or intestate succession. Postmortem exclusivity lasts 10 years, renewable in 5-year increments (subject to registration under § 651.151) up to a maximum of 70 years after the individual's death. For right holders who died before the act's effective date of September 1, 2025, rights vest retroactively in their estates.

Section 651.059 provides that a digital replica embodied in a fixed work (sound recording, image, audiovisual work, or transmission) and authorized under a license may continue to be used consistently with the license terms after the license expires or terminates — unless the license expressly prohibits post-termination use. This is a savings provision, not an affirmative obligation.

This creates a notice-and-takedown duty analogous to DMCA safe-harbor procedures.

Section 651.104 provides a safe harbor for manufacturers and distributors of general-purpose AI tools. A person does not violate § 651.053 merely by manufacturing, importing, or distributing a product or service unless the product is (1) primarily designed to produce unauthorized digital replicas, (2) has limited commercially significant use other than producing unauthorized replicas, or (3) is marketed for that purpose by the distributor or someone acting in concert with or with the knowledge of the distributor. This mirrors the secondary-liability framework from copyright's contributory-infringement doctrine.

Section 651.151 conditions the renewal of postmortem digital replication rights (beyond the initial 10-year period) on filing a notice with the Secretary of State. The notice must include the deceased individual's name, a statement under penalty of perjury of active and authorized public use during the preceding two-year period, the right holder's identity and contact information, and any other information the Secretary deems necessary.

(b) A right holderRight holder"Right holder" means: (A) the individual whose voice or visual likeness is simulated or otherwise copied in or as a digital replica; and (B) if applicable, any other person other than the individual described by Paragraph (A) that acquires, through a license, inheritance, or otherwise, the right to authorize the use of the individual's voice or visual likeness in a digital replica.Bus. & Com. Code § 651.001(9) may voluntarily apply to the secretary of state for inclusion on the directory described by this section by filing a notice with the secretary of state that complies with the form, content, and filing procedures prescribed by rule by the secretary of state. Section 651.152 directs the Secretary of State to maintain a public directory of registered postmortem digital replication rights. Right holders may voluntarily apply for inclusion by filing a notice that complies with the Secretary's prescribed form. The Secretary may impose a filing fee to cover administrative costs. This is a government-facing administrative provision.

Section 651.201 defines the standing requirement for enforcement actions. Eligible plaintiffs include: the right holder; a parent or guardian of a minor subject; any person controlling the authorization right through a license; any person owning or controlling the right for a deceased individual; and, for sound recording artists, a party with an exclusive personal services contract or exclusive distribution license.

(a)–(h) Sec. 651.203. PRIVATE CAUSE OF ACTION FOR UNAUTHORIZED USE. (a) In this section, "knowingly" means having actual knowledge of or acting with deliberate ignorance of the prohibition involved. (b) An eligible plaintiffEligible plaintiff"Eligible plaintiff" means a person authorized to bring an action under Section 651.201.Bus. & Com. Code § 651.001(3) may bring a cause of action against another person who knowingly violates Section 651.053. (c) For purposes of Subsection (a), a person may be presumed to have acted knowingly if the person: (1) is an online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7) that received a notification under Section 651.101 and failed to remove or disable access to the material under Section 651.102; or (2) wilfully avoided having knowledge that: (A) the applicable material is a digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1); and (B) the digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) was not authorized by a right holderRight holder"Right holder" means: (A) the individual whose voice or visual likeness is simulated or otherwise copied in or as a digital replica; and (B) if applicable, any other person other than the individual described by Paragraph (A) that acquires, through a license, inheritance, or otherwise, the right to authorize the use of the individual's voice or visual likeness in a digital replica.Bus. & Com. Code § 651.001(9). (d) A person must bring a cause of action under this section not later than the third anniversary after the date on which the person discovered, or with due diligence should have discovered, the violation. (e) It is not a defense in a cause of action brought under this section that the person alleged to have violated Section 651.053 displayed or otherwise communicated to the public a disclaimer stating that the digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) was unauthorized or disclosing that the digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) was generated through the use of artificial intelligence or other technology. (f) In a cause of action brought under this section, a person that violates Section 651.053 is liable to the aggrieved person for: (1) subject to Subsection (g), the greater of: (A) statutory damages in the amount of: (i) $5,000 per work embodying the unauthorized digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1), if the violator is an individualIndividual"Individual" means a natural or deceased person.Bus. & Com. Code § 651.001(4); (ii) $5,000 per violation, if the violator is an online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7); and (iii) $25,000 per work embodying the unauthorized digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1), if the violator is an entity other than an online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7); or (B) the sum of actual damages and profits attributable to the unauthorized use of the digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1); and (2) if a wilful violation is proven under which the violator is found to have acted with malice, fraud, knowledge, or wilful avoidance of knowledge that the conduct violated the law, punitive damages. (g) An online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7) that has an objectively reasonable belief that material claimed to be an unauthorized digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) does not qualify as a digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1) may not be liable for statutory or actual damages exceeding $1 million regardless of whether the material is ultimately determined to be an unauthorized digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1). (h) The remedies available under this section and Section 26.013, Property Code, for a violation arising out of the same conduct are mutually exclusive.

Attorney's fees

(1)–(2) Sec. 651.204. ATTORNEY'S FEES. If the prevailing party is: (1) the party bringing the action, the court shall award reasonable attorney's fees; or (2) the party defending the action, the court shall award reasonable attorney's fees if the court determines that the action was not brought in good faith.

Code § 651.001(7)'s reliance on the notice in removing or disabling access to the material or activity claimed to be an unauthorized digital replicaDigital replica"Digital replica" means a newly created, computer-generated, highly realistic electronic representation that is readily identifiable as the voice or visual likeness of an individual that: (A) is embodied in a sound recording, image, audiovisual work, including an audiovisual work that does not have any accompanying sounds, or transmission: (i) in which the individual did not actually perform or appear; or (ii) that is a version of a sound recording, image, or audiovisual work in which the individual did perform or appear, but in which the fundamental character of the performance or appearance has been materially altered; and (B) does not include the electronic reproduction, use of a sample of one sound recording or audiovisual work into another, remixing, mastering, or digital remastering of a sound recording or audiovisual work authorized by the copyright holder.Bus. & Com. Code § 651.001(1). (b) If a third party described by Section 651.102 files an action under this section, the online service providerOnline service provider"Online service provider" means the owner of an online service.Bus. & Com. Code § 651.001(7) may, provided the action is filed not later than the 14th day after the date a third party receives notice under Section 651.102(2)(B), restore the removed material to the online serviceOnline service"Online service" means: (A) any publicly accessible Internet website, online application, mobile application, or virtual reality environment, including a social media service, social media network, or online application store, that predominantly provides a community forum for user-generated content, including the sharing of videos, images, games, audio files, or other material; and (B) a digital music provider, as defined by 17 U.S.C. Section 115(e).Bus. & Com. Code § 651.001(6) without incurring monetary liability to either the notifying party or the third party.
