Texas SB 1964 regulates the procurement, development, deployment, and use of AI systems by state agencies and local governments. It creates two tiers of AI systems: general AI systems and 'heightened scrutiny' AI systems (those intended to autonomously make or be a controlling factor in consequential decisions affecting access to government services). The law requires DIR to establish an AI code of ethics aligned with the NIST AI RMF, develop minimum risk management standards for heightened scrutiny systems, and create an AI sandbox program. State agencies must disclose public-facing AI use, conduct impact assessments for heightened scrutiny systems, maintain AI inventories, and post standardized notices. Enforcement is through the attorney general via injunction, with a complaint web page for the public and a 30-day vendor cure period before contract voiding.
