Section 2(a) is the operative core of the bill, imposing a cluster of duties on any operator of a conversational AI service, with the heaviest obligations running to services accessible to minor account holders. Operators must disclose AI identity to minors through a persistent visible disclaimer or one that appears at the start of each interaction and at least every three hours of continuous use, and must provide an analogous general-consumer disclosure whenever a reasonable person would believe they are speaking with a human.

Beyond disclosure, the section prohibits unpredictable-interval engagement rewards for minors, requires reasonable measures preventing the service from producing sexually explicit or objectifying material or emotionally deceptive statements (including simulated sentience, emotional dependence, or adult-minor romantic role-play) toward minors, mandates parental screen-time and account-management tools, requires suicide and self-harm crisis-referral protocols, and bars operators from implying the service provides licensed professional psychology or behavioral health care.

Enforcement by Federal Trade Commission

(1) UNFAIR OR DECEPTIVE ACTS OR PRACTICES.—A violation of subsection (a) or a regulation promulgated under such subsection shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)) regarding unfair or deceptive acts or practices.

(2) POWERS OF COMMISSION.—The Federal Trade Commission shall enforce subsection (a) and any regulation promulgated under such subsection in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (15 U.S.C. 41 et seq.) were incorporated into and made a part of this section. Any person who violates such subsection or a regulation promulgated under such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.

Section 2(b) routes all enforcement through the Federal Trade Commission. A violation of the operative requirements in subsection (a), or of any implementing regulation, is treated as a violation of an FTC rule regarding unfair or deceptive acts or practices, and the Commission enforces with the same jurisdiction, powers, and duties as under the FTC Act. There is no private right of action, and no independent compliance duty is created here beyond the substantive obligations in subsection (a).

Section 2(c) defines the terms that set the scope of the bill's obligations. The conversational AI service definition is notable for its extensive carve-outs: it excludes R&D tools, embedded non-conversational features, narrow-topic tools, business-facing commerce assistants, voice-command virtual assistants, and internal business tools. Operator is limited to persons who both develop and make a service available to the public, and excludes app stores and search engines that merely provide access. Minor uses a knowledge/reasonable-certainty standard for under-18 users.

Sec. 2(d)
Applicability (effective date)

(d) APPLICABILITY.—This section shall take effect one year after the date of the enactment of this section.

Section 2(d) provides that the section takes effect one year after the date of enactment, giving operators a compliance runway before the disclosure, safety, and design obligations become operative.
