Section 2 defines the key terms used throughout the Act. The definition of artificial intelligence chatbot is notably narrow: it covers only open-ended, conversational AI systems and excludes customer service bots, operational business tools, productivity/analysis tools, internal research tools, technical assistance tools, and educational products. The covered entity definition is limited to websites, services, or applications whose primary function is providing an AI chatbot, meaning secondary chatbot features embedded in broader platforms may fall outside scope. The know standard encompasses both actual knowledge and constructive knowledge fairly implied from objective circumstances.

Section 3 imposes three distinct obligations on covered entities with respect to known child users. First, a covered entity must require creation and maintenance of a family account (meeting the Section 5 requirements) before permitting a known child to access the chatbot. Second, existing accounts of known children without family accounts — and known teens without parental consent — must be terminated as of the Act's effective date. Third, upon termination, the entity must immediately delete all personal data collected from or submitted by the user, while making that data available in a readable and portable format for 90 days post-termination. A rule of construction preserves the entity's ability to retain termination records and minimum compliance documentation.

(c) Nothing in this section shall be construed to require a covered entityCovered entityThe term "covered entity" means any public-facing website, online service, or software application that, as its primary function, provides an artificial intelligence chatbot to users.Sec. 2(5) to require a teenTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) or the parent of such teenTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) to provide government-issued identification for— (1) relationship verification; or (2) the provision of verifiable parental consent under subsection (a)(1).
Section 4 establishes the consent framework for teen users. Before a known teen can create an account, the covered entity must provide direct notice to a parent and obtain COPPA-standard verifiable parental consent. Parents must also be offered the option to create a family account. If parents decline the family account, all Section 5(a)(1) features must be locked at the most protective default. A COPPA-compliant reasonable-efforts standard serves as a safe harbor. Parents may revoke consent at any time, triggering account suspension or deletion. A rule of construction clarifies that government-issued identification may not be required for relationship verification or parental consent.

and (ii) any output of the artificial intelligence chatbot is generated using artificial intelligence.Sec. 2(11) and set the intervals at which the transparency labelTransparency labelThe term "transparency label" means a notice that— (A) is clearly and conspicuously displayed to a user; (b)(1) 12 Each covered entityCovered entityThe term "covered entity" means any public-facing website, online service, or software application that, as its primary function, provides an artificial intelligence chatbot to users.Sec. 2(5) shall ensure that the default setting of any parental control or setting described in subsection (a) for a family account is the option, or pre-set option (for purposes of paragraph (2)), that provides the most protective level of control with respect to the use of the artificial intelligence chatbotArtificial intelligence chatbotThe term "artificial intelligence chatbot" means artificial intelligence that, in an open-ended natural-language or multimodal manner— (A) accepts user input; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2) by a childChildThe term "child" means an individual who is under the age of 13.Sec. 2(3) or teenTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) userUserThe term "user" means, with respect to a covered entity, an individual who registers an account or creates a profile in order to access the artificial intelligence chatbot of the covered entity.Sec. 2(12).

Section 5 specifies the granular parental controls that family accounts must provide. Parents must be able to limit usage time, disable engagement-based rewards and incentives, disable notifications and push alerts, disable in-chatbot financial transactions, disable unsolicited chatbot outputs, and configure transparency label display intervals. Parents must also be able to set data-retention limits for how long the chatbot may use the child or teen's personal data before deletion, access a full conversation record with monitoring and analysis features, and receive alerts when the minor attempts to bypass controls. All controls must default to the most protective setting, and covered entities must offer pre-set tiered options for data-retention settings. Each control must be accompanied by a clear disclosure of its scope. Prior to family account creation, the covered entity must provide clear information about its policies and how to manage the account. The entity must also provide an accessible mechanism for reporting parental-control violations and contacting the entity.

Section 6 prohibits covered entities from using personal data of a known child or teen user for targeted advertising. The prohibition is categorical and is not waivable by parental consent. A rule of construction preserves the entity's ability to deliver age-appropriate advertising that does not rely on personal data other than the user's age, as well as contextual advertising and measurement-only data processing — all of which are carved out from the definition of targeted advertising in Sec. 2(9).

Section 7 establishes the evidentiary standard for determining knowledge of minor status and imposes data-minimization obligations on voluntarily collected age-related data. Knowledge is assessed under a totality-of-circumstances standard using competent and reliable evidence, including whether a reasonable and prudent person would have known the individual is a child or teen. Critically, the bill does not require covered entities to implement age gating, age verification, or affirmative age-data collection beyond normal business practices. Personal data voluntarily collected for compliance with the Act must not be used for any other purpose and must not be retained longer than necessary for compliance.
(a)(1)–(2) UNFAIR OR DECEPTIVE ACTS OR PRACTICES.—A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade CommissionCommissionThe term "Commission" means the Federal Trade Commission.Sec. 2(4) Act (15 U.S.C. 57a(a)(1)(B)). (b)(1)–(5) AUTHORIZATION.—Subject to paragraph (3), in any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of a covered entityCovered entityThe term "covered entity" means any public-facing website, online service, or software application that, as its primary function, provides an artificial intelligence chatbot to users.Sec. 2(5) in a practice that violates section 3 or 4, the attorney general of the State may, as parens patriae, bring a civil action against the covered entityCovered entityThe term "covered entity" means any public-facing website, online service, or software application that, as its primary function, provides an artificial intelligence chatbot to users.Sec. 2(5) on behalf of the residents of the State in an appropriate district court of the United States to— (A) enjoin such practice; (B) enforce compliance with this Act; (C) on behalf of residents of the State, obtain damages, restitution, or other compensation, each of which shall be distributed in accordance with State law; or (D) obtain such other relief as the court may consider to be appropriate. (3) INVESTIGATORY POWERS.—Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to— (A) conduct investigations; (B) administer oaths or affirmations; or (C) compel the attendance of witnesses or the production of documentary or other evidence. (4) PREEMPTIVE ACTION BY THE COMMISSIONCommissionThe term "Commission" means the Federal Trade Commission.Sec. 2(4).—In any case in which an action is instituted by or on behalf of the CommissionCommissionThe term "Commission" means the Federal Trade Commission.Sec. 2(4) for a violation of this Act, no State may, during the pendency of that action, institute a separate civil action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the CommissionCommissionThe term "Commission" means the Federal Trade Commission.Sec. 2(4) for that violation. (5) VENUE; SERVICE OF PROCESS.— (A) VENUE.—Any action brought under paragraph (1) may be brought in— (i) the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or (ii) another court of competent jurisdiction. (B) SERVICE OF PROCESS.—In an action brought under paragraph (1), process may be served in any district in which the defendant— (i) is an inhabitant; or (ii) may be found.
Section 8 establishes a dual enforcement framework. The FTC enforces the entire Act using its existing authority under the FTC Act, treating violations as unfair or deceptive acts or practices under § 18(a)(1)(B). State attorneys general may bring parens patriae civil actions for violations of Sections 3 or 4 (family accounts and parental consent), seeking injunctive relief, compliance enforcement, damages, restitution, or other appropriate relief. States must provide written notice to the FTC before filing suit (or immediately upon filing if pre-suit notice is infeasible). The FTC may intervene in state AG actions. A pending FTC action preempts state AG suits against the same defendant. No private right of action is created.
(a)–(b) IN GENERAL.—Subject to subsection (b), the provisions of this Act shall preempt any related State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this Act. (b) RULES OF CONSTRUCTION.—Nothing in this Act shall be construed to— (1) prohibit a State from enacting a law, rule, or regulation that provides greater protection to children than the protections provided in this Act; or (2) affect the application of— (A) section 444 of the General Education Provisions Act (20 U.S.C. 1232g, commonly known as the ''Family Educational Rights and Privacy Act of 1974'') or other Federal or State laws governing student privacy; or (B) the Children's Online Privacy Protection Act of 1998 (15 U.S.C. 6501 et seq.) or any rule or regulation promulgated under such Act.
Section 9 establishes a narrow conflict preemption framework. The Act preempts state laws only to the extent they directly conflict with its provisions. It expressly preserves states' ability to enact laws providing greater protection to children. It also preserves the applicability of FERPA and COPPA and any rules promulgated under them.

(b) SCOPE.—The study required under subsection (a) shall examine, with respect to children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10)— (1) the use of artificial intelligence chatbotsArtificial intelligence chatbotThe term "artificial intelligence chatbot" means artificial intelligence that, in an open-ended natural-language or multimodal manner— (A) accepts user input; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2) by children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) to meet companionship or social needs and the resulting effects on the real-world social engagement and mental health of children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10); (2) the prevalence and effects of sycophantic or excessively affirming behavior by artificial intelligence chatbotsArtificial intelligence chatbotThe term "artificial intelligence chatbot" means artificial intelligence that, in an open-ended natural-language or multimodal manner— (A) accepts user input; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2) on children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10); and (3) the role of design features of artificial intelligence chatbotsArtificial intelligence chatbotThe term "artificial intelligence chatbot" means artificial intelligence that, in an open-ended natural-language or multimodal manner— (A) accepts user input; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2) in shaping the results of paragraphs (1) and (2). (c) METHODOLOGY.—The study required under subsection (a) shall draw on existing research, expert consultation, and, where feasible, observational, experimental, and survey-based data collection, consistent with applicable ethical standards and requirements for research involving children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10). (d) REPORT.—Not later than 1 year after the date of enactment of this Act, the Director of the National Science Foundation shall submit to the Committee on Commerce, Science and Transportation of the Senate and the Committee on Energy and Commerce and the Committee on Science, Space, and Technology of the House of Representatives a report containing the findings of the study conducted under subsection (a).
Section 10 directs the National Science Foundation to conduct or commission a study within two years of enactment on the effects of AI chatbots on human relationships and social needs of children and teens, covering companionship-seeking behavior, sycophantic chatbot behavior, and design feature influences. The study must use ethical research methods. A report is due to Congress within one year of enactment. This is a government research mandate, not a covered-entity compliance obligation.

(2) the adoption rate of family accounts by parents of children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10); (3) the rate of compliance with the requirements of this Act by covered entities; (4) the effectiveness of each parental control or setting required within a family account, including recommendations or best practices to provide the most protective or ideal level of control for children and teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10), including analysis of the parental control described in section 5(a)(2), including— (A) using best available research or industry data; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2) to generate outputs not consistent with its behavior parameters; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2), with reference to the data described in paragraph (4); (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2); (7) recommendations to the CommissionCommissionThe term "Commission" means the Federal Trade Commission.Sec. 2(4) for improving enforcement of this Act; and (8) recommendations to Congress for potential legislative improvement to this Act. (b) CONSULTATION REQUIREMENT.—In carrying out the report required under subsection (a), the Comptroller General shall consult with each of the following: (1) The National Institute of Standards and Technology. (4) Parents of children or teenTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) usersUserThe term "user" means, with respect to a covered entity, an individual who registers an account or creates a profile in order to access the artificial intelligence chatbot of the covered entity.Sec. 2(12) of artificial intelligence chatbotsArtificial intelligence chatbotThe term "artificial intelligence chatbot" means artificial intelligence that, in an open-ended natural-language or multimodal manner— (A) accepts user input; (B) engages in interactive conversations with a user; and (C) provides outputs that are not— (i) pre-determined or scripted; (ii) limited to contextualized replies or to a narrow, specified purpose, such as— (I) customer service; (II) any operational purpose of a business; (III) productivity and analysis related to source information; (IV) internal research; or (V) technical assistance; or (iii) limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.Sec. 2(2). (5) Individuals with experience advocating for online childChildThe term "child" means an individual who is under the age of 13.Sec. 2(3) safety, consumer protection, or online privacy. (6) Individuals with experience in artificial intelligenceArtificial intelligenceThe term "artificial intelligence" has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401).Sec. 2(1), computer science, and software engineering. (7) Academic experts with expertise in prevention of online harms to children or teensTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10). (8) Other relevant Federal agencies with expertise in childChildThe term "child" means an individual who is under the age of 13.Sec. 2(3) or teenTeenThe term "teen" means an individual who has attained 13 years of age but has not attained 18 years of age.Sec. 2(10) online safety.
Section 11 requires the Comptroller General to submit a report within two years of the Act's effective date examining the Act's effectiveness, family account adoption rates, compliance rates, parental control effectiveness, model-drift analysis, and best-practice recommendations. The GAO must consult with NIST, the FTC, covered entities, parents, child safety advocates, AI experts, and other relevant stakeholders. This is a government reporting mandate, not a covered-entity compliance obligation.
This Act shall take effect on the date that is 1 year after the date of enactment of this Act.
Section 12 provides that the Act takes effect one year after the date of enactment, giving covered entities a one-year compliance runway.
