Enforcement Authority
The Digital Voyeurism Prevention Act (Chapter 72b) is enforced via private right of action by injured persons or heirs. The Digital Content Provenance Standards Act (Chapter 72c) is administered and enforced by the Division of Consumer Protection; the division director may impose administrative fines, and the division or attorney general may bring court actions. No private right of action exists under Chapter 72c. Generation services and covered platforms benefit from safe harbor protections assertable by pre-trial motion; heightened pleading standards require plaintiffs to plead with particularity facts negating safe harbor eligibility.

Digital Voyeurism Prevention Act — Definitions

As used in this chapter: (1) "Artificial intelligence technologyArtificial intelligence technology"Artificial intelligence technology" means the same as that term is defined in Section 13-72-101.Utah Code § 13-72b-101(1)" means the same as that term is defined in Section 13-72-101. This section establishes the definitions for the Digital Voyeurism Prevention Act, including the key terms generation service, covered platform, counterfeit intimate image, consent, and identifiable individual. The definitions incorporate several terms by reference to the federal Take It Down Act and 18 U.S.C. § 2256. Notably, the definition of distribute is broad enough to encompass the act of generating a counterfeit intimate image by a generation service and then providing it to the user — meaning the generation itself triggers distribution liability even before any third-party sharing.

(4) 2 A generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) may not require an individual to disclose personally identifiable information beyond what is reasonably necessary to assure the individual's identity and obtain valid consentConsent"Consent" means express permission, freely and voluntarily given by an identifiable individual, with full knowledge of the nature and purpose of the generation of an intimate image depicting the individual, where the consent: (a) is specific to the particular intimate image being generated; (b) is obtained before the generation of the intimate image; and (c) may be revoked at any time.Utah Code § 13-72b-101(2).

This section establishes the core prohibition of the Digital Voyeurism Prevention Act: a generation service may not distribute a counterfeit intimate image without first obtaining consent from the depicted identifiable individual. The consent must be affirmative, identity-verified with reasonable accuracy, specific to the particular image, and obtained before distribution. Consent records must be retained for at least seven years. The section also imposes a data-minimization requirement, prohibiting collection of personally identifiable information beyond what is reasonably necessary for identity verification and consent.

Civil liability for generation services

(1)–(6) A person, or the heirs of a deceased person, who has been injured by a violation recognized in Section 13-72b-201 may bring a civil action against the generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) that committed the violation. This section establishes the private right of action and damages framework for violations by generation services. An injured person or the heirs of a deceased person may sue; no proof of actual damages is required. Available remedies include actual damages (including emotional distress), punitive damages for willful, reckless, or malicious violations, attorney fees, and mandatory injunctive relief and image removal/destruction. Each distribution constitutes a separate violation. The statute of limitations runs to the later of three years from discovery or ten years from the date of violation.

Safe harbor for generation services

(1)–(5) A generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (5) A generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) may assert the safe harbor protections under this section by motion before trial and is not required to proceed to trial to establish eligibility for the safe harbor.

This section provides a safe harbor from liability for generation services that demonstrate compliance with a set of enumerated conditions: maintaining a written policy prohibiting non-consensual NCII with reasonable safeguards, publishing that policy, maintaining a compliant consent system, and taking prompt action upon notice. A generation service that categorically prevents intimate image generation is exempt from several of the consent-system requirements. The court must consider whether safeguards are consistent with industry standards, regularly updated, and include technical anti-circumvention measures. The safe harbor may be asserted by pre-trial motion.

Heightened pleading standard for actions against generation services

(2) To meet the pleading requirements of Subsection (1), the plaintiff shall include specific factual allegations, including dates, communications, and other evidence, demonstrating that the generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) does not qualify for safe harbor protection under Section 13-72b-203, including facts showing one or more of the following: (a) that the generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) holds itself out as providing services for creating counterfeit intimate imagesCounterfeit intimate image"Counterfeit intimate image" means a "digital forgery" as that term is defined in the Take It Down Act.Utah Code § 13-72b-101(3); (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) intentionally designed the service to facilitate the creation of non-consensual counterfeit intimate imagesCounterfeit intimate image"Counterfeit intimate image" means a "digital forgery" as that term is defined in the Take It Down Act.Utah Code § 13-72b-101(3). (3) General or conclusory allegations that a generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) violated this part are insufficient to state a claim. (4) If a complaint fails to meet the pleading requirements of this section, the court shall dismiss the action without prejudice. (5) A generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) may bring a motion to dismiss under this section before filing an answer or other responsive pleading. (6) If the court grants a motion to dismiss under this section and the plaintiff files an amended complaint that again fails to meet the pleading requirements of this section, the court shall: (a) dismiss the action with prejudice; and (b) award the generation serviceGeneration service"Generation service" means a person that operates, maintains, or provides an interactive computer service that: (a) enables users to generate intimate images; (b) processes user image generation requests through servers, computer systems, or computing resources controlled by the service operator rather than solely on the user's local device; and (c) distributes generated intimate images to users through the service.Utah Code § 13-72b-101(7) reasonable attorney fees and costs incurred in bringing the motion to dismiss the amended complaint.

This section imposes a heightened pleading standard on plaintiffs suing generation services, requiring particularized factual allegations — including dates, communications, and evidence — that negate safe harbor eligibility. General or conclusory allegations are insufficient. Failure to meet the standard results in dismissal without prejudice on first attempt and with prejudice (plus attorney fees to the defendant) on a second failed attempt.

This section creates the private right of action against covered platforms that violate § 13-72b-301. The remedies mirror those for generation services: actual damages including emotional distress (no proof of actual damages required), punitive damages for willful/reckless/malicious violations, attorney fees, injunctive relief, and image removal/destruction. Each failure to comply with takedown requirements after notice constitutes a separate violation. The same 3-year discovery / 10-year absolute statute of limitations applies.

The safe harbor applies even if NCII appeared on the platform, provided the platform had no actual knowledge before notice and complied with takedown requirements upon notice. Courts must consider platform size, content volume, proactive measures, and industry-standard consistency. The safe harbor may be raised by motion to dismiss or summary judgment, and successful assertion entitles the platform to attorney fees.

This section mirrors the heightened pleading standard for generation services, requiring plaintiffs suing covered platforms to plead with particularity facts negating safe harbor eligibility — including, where applicable, specific dates and content of notices, the platform's response or failure to respond, or facts establishing actual knowledge without notice. The same dismissal-with-prejudice and fee-shifting consequences apply on second failure.

This section defines the terms used in the Digital Content Provenance Standards Act. Key covered entities include large online platform (social media, mass messaging, or search with over 2 million monthly users), capture device manufacturer, and covered provider (developer of a generative AI system with over 1 million monthly users that is publicly accessible in Utah). The section also defines provenance data, system provenance data, compliant system provenance data, and digital signature — the technical building blocks of the provenance obligations that follow.

This section imposes three affirmative provenance obligations on large online platforms: detecting whether compliant system provenance data is embedded in or attached to distributed content, providing a user interface to disclose provenance-data availability, and allowing users to inspect all available compliant system provenance data through the platform's interface, download, or a link. It also prohibits platforms from knowingly stripping standards-compliant provenance data or digital signatures from uploaded or distributed content, to the extent technically feasible.

Enforcement — Civil liability (Provenance Standards)

(1)–(8) The Division of Consumer Protection shall administer and enforce the provisions of Part 2, Content Provenance Standards and Requirements in accordance with Chapter 2, Division of Consumer Protection. (2) In addition to the division's enforcement powers under Chapter 2, Division of Consumer Protection: (a) the division director may impose an administrative fine of up to $2,500 for each violation of this chapter; and (b) the division may bring an action in a court of competent jurisdiction to enforce a provision of this chapter. (3) In a court action by the division to enforce a provision of this chapter, the court may: (a) declare that an act or practice violates a provision of this chapter; (b) issue an injunction for a violation of this chapter; (c) order disgorgement of money received in violation of this chapter; (d) order payment of disgorged money to an injured purchaser or consumer; (e) impose a fine of up to $2,500 for each violation of this chapter; or (f) award other relief that the court determines reasonable and necessary. (4) If a court awards judgment or injunctive relief to the division, the court shall award the division: (a) reasonable attorney fees; (b) court costs; and (c) investigative fees. (5) A court may impose a civil penalty of no more than $5,000 for each violation of an administrative or court order issued for a violation of this chapter. (6) The attorney general may bring a civil action on behalf of the division to collect a civil penalty imposed under this section. (7) The division shall deposit all fines and civil penalties collected under this section into the Consumer Protection Education and Training Fund created in Section 13-2-8. (8) Nothing in this chapter shall displace any other available remedies or rights authorized under the laws of this state or the United States.

(1)–(3) 11 The chief information officer shall make rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, establishing standards for digital content on a webpage of a state agency that the public can access to facilitate a transaction or obtain a service if the chief information officer determines there is a substantial risk that fraudulent or misleading media could cause harm to a resident of the state interacting with the state agency. (2) The standards required by Subsection (1) shall require a digitally accessible provenance record containing provenance information for digital content captured, created, or edited that includes: (a) the identification of: (i) the type of software or tool used; or (ii) the specific tool used; (b) the date of creation; (c) a content identifier; and (d) the previous content identifiers, if applicable. (3) This section does not apply to digital content created before January 1, 2027.
