Section 59.1-607 establishes the definitional framework for the chapter. The key scope-limiting definitions are high-risk artificial intelligence system (AI specifically intended to autonomously make, or be a substantial factor in making, a consequential decision) and consequential decision (material legal or similarly significant effects on parole, education, employment, financial services, healthcare, housing, insurance, marital status, or legal services). The definition of high-risk AI includes a lengthy list of 19 categorical exclusions, notably including chatbot-style technology subject to an acceptable use policy prohibiting discriminatory or unlawful content. Algorithmic discrimination is defined as unlawful differential treatment or impact disfavoring individuals on protected characteristics, but expressly excludes self-testing, diversity-expansion, and private-club activities. The consumer definition is limited to Virginia residents acting in an individual or household context — excluding commercial and employment contexts.

Section 59.1-608 establishes the core obligations for developers of high-risk AI systems. The overarching duty is a reasonable duty of care to protect consumers from known or reasonably foreseeable risks of algorithmic discrimination, with a rebuttable presumption of compliance for developers who satisfy the section's requirements. Developers must provide deployers with comprehensive documentation covering intended uses, system limitations, known discrimination risks, performance evaluation methods, mitigation measures, and monitoring guidance. Developers must also furnish impact-assessment-enabling artifacts such as system cards and predeployment assessments.
Developers of high-risk generative AI systems face an additional synthetic-content identification requirement: outputs in audio, image, or video format must be identifiable and detectable using industry-standard tools at the time of generation, with exceptions for artistic works and text-only outputs. Conformity with the NIST AI RMF, ISO/IEC 42001, or equivalent frameworks creates a rebuttable presumption of compliance. Disclosures must be updated within 90 days of any intentional and substantial modification. A developer that also serves as its own deployer need not generate the deployer-facing documentation unless the system is provided to an unaffiliated deployer.

Code § 59.1-607, information that could create a security risk, or other confidential or proprietary information protected under state or federal law.
Section 59.1-609 is the longest and most obligation-dense section of the act, imposing a layered set of requirements on deployers. Like the developer standard, the overarching duty is a reasonable duty of care against algorithmic discrimination, with a rebuttable presumption of compliance for deployers who follow the section's requirements. Deployers must implement a documented risk management policy and program that is reasonable in light of the NIST AI RMF, ISO/IEC 42001, or equivalent frameworks.
Before deploying a high-risk AI system and before each significant update, deployers must complete a detailed impact assessment covering purpose, discrimination risks, data inputs and outputs, performance metrics, transparency measures, post-deployment monitoring, and validity analysis. Impact assessments and all supporting records must be retained for at least three years after final deployment. Deployers must also disclose to consumers at the time of interaction that they are interacting with an AI system, including the system's purpose, nature, the nature of the consequential decision, and a plain-language description of measured attributes and human components. For adverse consequential decisions, deployers must provide the principal reasons for the decision, data correction rights under the VCDPA, and an appeal mechanism with human review where technically reasonable. Deployers must make publicly available a summary of their algorithmic discrimination risk management approach. Disclosures must be updated within 30 days of developer notification of an intentional and substantial modification. Deployers who themselves perform intentional and substantial modifications must comply with developer documentation and disclosure requirements.

(I) Nothing in this chapter shall create a private cause of action in favor of any personPerson"Person" includes any individual, corporation, partnership, association, cooperative, limited liability company, trust, joint venture, or any other legal or commercial entity and any successor, representative, agent, agency, or instrumentality thereof. "Person" does not include any government or political subdivision.Va. Code § 59.1-607 aggrieved by a violation of this chapter.
Section 59.1-611 vests exclusive enforcement authority in the Attorney General and expressly bars any private cause of action. The AG may issue civil investigative demands (with trade secret protections and attorney-client privilege preserved), seek injunctive relief in circuit court, and impose civil penalties up to $1,000 per violation (or $1,000–$10,000 for willful violations) plus attorney fees, expenses, and costs. Each violation is a separate offense. The AG may require production of developer documentation and deployer risk management policies, impact assessments, and records relevant to an investigation.
Two enforcement-mitigation mechanisms are available. First, an affirmative defense exists where the developer or deployer discovers a violation through red-teaming or other method, cures within 45 days, notifies the AG with evidence of mitigation, and is otherwise in compliance. Second, before bringing suit the AG must consult with the developer or deployer on the possibility of a cure, and may issue a notice of violation with a 45-day cure period, considering factors including the number of violations, entity size, likelihood of public injury, and whether the violation was caused by human or technical error.

(B) If any provision of this chapter or its application to any personPerson"Person" includes any individual, corporation, partnership, association, cooperative, limited liability company, trust, joint venture, or any other legal or commercial entity and any successor, representative, agent, agency, or instrumentality thereof. Code § 59.1-607 or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this chapter that can be given effect without the invalid provision or application, and to this end all the provisions of this chapter are hereby expressly declared to be severable.
Section 59.1-612 contains two interpretive provisions. First, the chapter is declared remedial, with consumer-protective provisions construed broadly and exemptions construed narrowly. Second, a standard severability clause ensures that invalidation of any provision does not affect the remainder of the chapter.
Clause 2 That the provisions of this act shall become effective on July 1, 2026.
Clause 3 That compliance with the provisions of Chapter 58 (§ 59.1-607 et seq.) of Title 59.1 of the Code of Virginia, as created by this act, shall not (i) relieve a personPerson"Person" includes any individual, corporation, partnership, association, cooperative, limited liability company, trust, joint venture, or any other legal or commercial entity and any successor, representative, agent, agency, or instrumentality thereof. Enactment clause 2 sets the effective date at July 1, 2026. Enactment clause 3 provides a savings clause ensuring that compliance with the new chapter does not relieve any person of liability for pre-existing common law or statutory causes of action, nor modify, preempt, limit, or displace those causes of action.
