Prohibits processing personal data without affirmative consent, bans use of chat logs for advertising, prohibits sale of chat logs, restricts profiling, and imposes heightened consent requirements for processing minor users' data. Requires clear and conspicuous AI identity disclosure before output generation, repeated hourly, and on-demand. Mandates monthly safety evaluations and public disclosure of chatbot information. Classifies chatbots as products for product liability purposes and imposes strict liability on providers. Creates a private right of action with up to $5,000 per violation and punitive damages for reckless or knowing conduct, enforceable by the Attorney General, county attorneys, or injured users.
