Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes. (6) 'Generative artificial intelligence systemGenerative artificial intelligence system'Generative artificial intelligence system' means a computer based system that uses machine learning or similar techniques involving large language models or deep learning models trained on one or more datasets and that is intended to generate, with some degree of autonomy, synthetic content, including, but not limited to, images, videos, audio, text, and other digital content, that emulates the structure and characteristics of such datasets.O.C.G.A. § 39-5-6(a)(6)' means a computer based system that uses machine learning or similar techniques involving large language models or deep learning models trained on one or more datasets and that is intended to generate, with some degree of autonomy, synthetic content, including, but not limited to, images, videos, audio, text, and other digital content, that emulates the structure and characteristics of such datasets. (7) 'Minor accountMinor account'Minor account' means an account which has a minor account holder.O.C.G.A. § 39-5-6(a)(7)' means an account which has a minor account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1). (9) 'Sexually explicit conductSexually explicit conduct'Sexually explicit conduct' shall have the same meaning as set forth in Code Section 16-12-100.O.C.G.A. § 39-5-6(a)(9)' shall have the same meaning as set forth in Code Section 16-12-100.
Subsection (a) establishes the definitions applicable to the entire code section. Key defined terms include conversational AI service, which is scoped to general-public-facing generative AI systems that primarily simulate human conversation but carves out developer/researcher tools, narrow-topic systems, B2B products, voice assistants for consumer electronics, and internal business tools. The operator definition targets the person who owns, controls, and makes the service available to the public, expressly excluding app store providers and search engines that merely provide access.
(b)(1)–(2) 1 An operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall clearly and conspicuously disclose to a minor account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1) that he or she is interacting with a conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) as opposed to a natural person: (1) With a constantly visible disclaimer; or (2) At the beginning of each session and appearing at least every three hours in a continuous conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) interaction.
Subsection (b) imposes an unconditional AI identity disclosure obligation on operators with respect to minor account holders. The operator must clearly and conspicuously disclose that the user is interacting with a conversational AI service rather than a natural person, using one of two methods: a constantly visible disclaimer or a session-start disclosure plus reminders at least every three hours during continuous interaction. Unlike the general-population disclosure in subsection (e), this obligation is not conditioned on a reasonable-person-misled standard — it applies to all minor account holders regardless.
(c) 2 An operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall not provide a minor accountMinor account'Minor account' means an account which has a minor account holder.O.C.G.A. § 39-5-6(a)(7) with points or similar rewards at unpredictable intervals with the intent to encourage increased engagement with the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5).
Subsection (c) prohibits operators from providing minor accounts with points or similar rewards at unpredictable intervals with the intent to encourage increased engagement. This targets variable-ratio reward schedules — a design pattern associated with addictive engagement — specifically when directed at minors.
(d)(1)–(3) 3 For minor account holdersAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1), the operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall institute reasonable measures to prevent the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) from: (1) Producing visual material of sexually explicit conductSexually explicit conduct'Sexually explicit conduct' shall have the same meaning as set forth in Code Section 16-12-100.O.C.G.A. § 39-5-6(a)(9); (2) Generating statements that suggest the account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1) engage in sexual conduct; (3) Generating statements that sexually objectify the account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1);
(d)(4)(A)–(D) 4 Generating statements that would lead a reasonable person to believe that the person is interacting with a natural person, including but not limited to: (A) Explicit claims that the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) is sentient or a natural person; (B) Statements that simulate emotional dependence; (C) Statements that simulate romantic or sexual innuendos; or (D) Role-playing of adult-minor romantic relationships.
Subsection (d) requires operators to institute reasonable measures to prevent the conversational AI service from producing four categories of harmful content toward minor account holders: (1) visual material of sexually explicit conduct, (2) statements suggesting the account holder engage in sexual conduct, (3) statements that sexually objectify the account holder, and (4) statements that would lead a reasonable person to believe they are interacting with a natural person — including claims of sentience, simulated emotional dependence, romantic or sexual innuendos, and adult-minor romantic role-playing. This subsection combines content restrictions with anti-deception protections specifically in the minor context.
(e) 5 If an individual could reasonably be expected to be misled to believe he or she was interacting with a natural person, an operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall clearly and conspicuously disclose that the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) is not a natural person.
Subsection (e) imposes a conditional AI identity disclosure requirement for all users — not limited to minors. If an individual could reasonably be expected to be misled into believing they are interacting with a natural person, the operator must clearly and conspicuously disclose that the conversational AI service is not a natural person. This is the general-population counterpart to the unconditional minor disclosure in subsection (b).
(f)(1)–(3) 6 Before allowing access to a conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) that could provide synthetic content containing sexually explicit conductSexually explicit conduct'Sexually explicit conduct' shall have the same meaning as set forth in Code Section 16-12-100.O.C.G.A. § 39-5-6(a)(9), an operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall use a reasonable age verification method, which may include, but not be limited to: (1) The submission of a digitized identification card, including a digital copy of a driver's license; (2) The submission of government issued identification; or (3) Any commercially reasonable age verification method that meets or exceeds an Identity Assurance Level 2 standard as defined by the National Institute of Standards and Technology.
Subsection (f) requires operators to use a reasonable age verification method before allowing access to a conversational AI service that could provide synthetic content containing sexually explicit conduct. The statute lists three non-exclusive methods: digitized identification card, government-issued identification, or any commercially reasonable method meeting or exceeding NIST Identity Assurance Level 2. This is a pre-access gate — the obligation applies before access, not after a minor is identified.
(g) 7 An operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall offer tools for a minor account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1)'s parent or guardian to manage the account holderAccount holder'Account holder' means an individual who has an account or profile to use a conversational AI service.O.C.G.A. § 39-5-6(a)(1)'s privacy and account settings.
Subsection (g) requires operators to offer tools to a minor account holder's parent or guardian enabling management of the account holder's privacy and account settings. The statute does not prescribe specific tool features, leaving the scope of tools to the operator's discretion.
(h) 8 An operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall adopt a protocol for the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) to respond to a user prompt regarding suicidal ideation or self-harm, which shall include making reasonable efforts to provide a response which refers the user to crisis service providers.
Subsection (h) requires operators to adopt a protocol for responding to user prompts regarding suicidal ideation or self-harm. The protocol must include making reasonable efforts to provide a response referring the user to crisis service providers. Unlike some comparable statutes, this provision applies to all users — not just minors — and requires adoption of the protocol rather than imposing it as a pre-access gate.
(i) 9 An operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8) shall not knowingly and intentionally cause or program a conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) to make any representation or statement that explicitly indicates that the conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) is designed to provide professional mental or behavioral health care.
Subsection (i) prohibits operators from knowingly and intentionally causing or programming a conversational AI service to make representations or statements that explicitly indicate the service is designed to provide professional mental or behavioral health care. This targets false professional-services claims rather than the provision of health information generally.
(j) The Attorney General may bring civil enforcement actions for violations of this Code section for injunctive relief or civil penalties up to $10,000.00 per violation.
Subsection (j) grants the Attorney General authority to bring civil enforcement actions for violations of this code section. Available remedies include injunctive relief and civil penalties up to $10,000 per violation.
(k) Nothing in this code section shall be construed to create liability for the developer of a conversational AI serviceConversational AI service'Conversational AI service' means a generative artificial intelligence system offered as a software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communication. Such term shall not include an application, web interface, or computer program that: (A) Is primarily designed and marketed for use by developers or researchers; (B) Is designed to provide outputs relating to a narrow and discrete topic; (C) Is primarily designed and marketed for commercial use by business entities; (D) Functions as a speaker and voice command interface, or voice activated virtual assistant for a consumer electronic device; or (E) Is used by a business solely for internal purposes.O.C.G.A. § 39-5-6(a)(5) which is made available to the public by a separate operatorOperator'Operator' means a person that owns, controls, and makes available a conversational AI service to the public. Such term shall not include an app store provider or search engine solely because the app store provider or search engine provides access to a conversational AI service.O.C.G.A. § 39-5-6(a)(8).
(l) Nothing in this Code section shall be construed to limit or preclude any other available remedy at law or equity.
Subsection (k) is a developer safe harbor: it expressly provides that nothing in this code section creates liability for the developer of a conversational AI service that is made available to the public by a separate operator. Subsection (l) is a savings clause preserving all other available remedies at law or equity. Neither subsection creates a new affirmative compliance obligation.
