This chapter shall be known and may be cited as the "Conversational AI Safety Act."
Establishes the short title of the chapter as the "Conversational AI Safety Act." This section creates no compliance obligation.
(1)–(8) As used in this chapter: (1) "Account holderAccount holder"Account holder" means an individual who has or opens an account or profile to use a conversational AI service.Idaho Code § 48-2102(1)" means an individualIndividual"Individual" means a natural person.Idaho Code § 48-2102(3) who has or opens an account or profile to use a conversational AI serviceConversational AI service"Conversational AI service" means an artificial intelligence software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communications. "Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2). (2)(a) "Conversational AI serviceConversational AI service"Conversational AI service" means an artificial intelligence software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communications. "Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2)" means an artificial intelligence software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communications. (b) "Conversational AI serviceConversational AI service"Conversational AI service" means an artificial intelligence software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communications. Section 48-2102 defines the key terms used throughout the Conversational AI Safety Act. The definition of "conversational AI service" is central and includes nine enumerated carve-outs that significantly narrow the scope of the statute — excluding developer/researcher tools, embedded features, video game chatbots (with a mental-health exception), narrow-topic tools, commercial/enterprise products, voice assistants, internal-use systems, contract-only systems, and customer-service chatbots. The definition of "minor" is notable because it requires the operator to have actual knowledge or reasonable certainty that the individual is under eighteen, rather than imposing a constructive knowledge standard.
The definition of "operator" excludes mobile application stores and search engines that merely provide access to a conversational AI service, paralleling California SB 243's approach to platform intermediaries.

"Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2) to respond to user prompts regarding suicidal ideation that includes but is not limited to making reasonable efforts to provide a response to users that refers them to crisis service providers such as a suicide hotline, crisis text line, or other appropriate crisis services.
(3) 3 An operatorOperator"Operator" means a person who makes available a conversational AI service to the public. "Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2) to make any representation or statement that explicitly indicates that the conversational AI serviceConversational AI service"Conversational AI service" means an artificial intelligence software application, web interface, or computer program that is accessible to the general public and that primarily simulates human conversation and interaction through textual, visual, or aural communications. "Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2) is designed to provide professional mental or behavioral health care.
Section 48-2103 establishes three core operating obligations for all operators of conversational AI services, applicable regardless of the user's age. First, operators must disclose the AI nature of the service when reasonable persons would be misled into believing they are interacting with a human — a conditional disclosure triggered by a reasonable-person standard. Second, operators must adopt a crisis response protocol specifically for suicidal ideation, including referral to crisis service providers. Third, operators are prohibited from knowingly and intentionally causing the service to represent itself as providing professional mental or behavioral health care.
The crisis protocol obligation is narrower than California SB 243's equivalent — it covers only suicidal ideation and does not explicitly extend to self-harm. The mental health care representation prohibition adds a dual knowledge requirement ("knowingly and intentionally") that creates a higher mens rea threshold than a strict liability or negligence standard.

"Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2) interaction.

"Conversational AI service" does not include a software application, web interface, or computer program that is any of the following: (i) Primarily designed and marketed for use by developers or researchers; (ii) A feature within another software application, web interface, or computer program that is not a conversational AI service; (iii) A chatbot that is a feature of a video game that is limited to replies related to the video game and that does not discuss topics related to mental health, self-harm, or material harmful to minors or maintain a dialogue on other topics unrelated to the video game; (iv) Designed to provide outputs relating to a narrow and discrete topic; (v) Primarily designed and marketed for commercial use by business entities, including those whose primary intended users are employees, contractors, or clients of business entities, whether delivered via cloud, on premises, or hybrid deployments; (vi) Designed to function as a speaker and voice command interface or voice-activated virtual assistant for a consumer electronic device; (vii) Used by a business solely for internal purposes; (viii) Accessible only to individuals who have entered into a commercial agreement, enterprise contract, or similar business arrangement with the operator; or (ix) A chatbot used only for customer service, a business's operational purposes, productivity purposes, or analysis related to source information, internal research, or technical assistance.Idaho Code § 48-2102(2) from: (a) Producing visual material of sexually explicit conductSexually explicit conduct"Sexually explicit conduct" and "visual depiction" have the same meanings as provided in 18 U.S.C. 2256.Idaho Code § 48-2102(8); (b) Generating direct statements that the account holderAccount holder"Account holder" means an individual who has or opens an account or profile to use a conversational AI service.Idaho Code § 48-2102(1) should engage in sexually explicit conductSexually explicit conduct"Sexually explicit conduct" and "visual depiction" have the same meanings as provided in 18 U.S.C. 2256.Idaho Code § 48-2102(8); or (c) Generating statements that sexually objectify the account holderAccount holder"Account holder" means an individual who has or opens an account or profile to use a conversational AI service.Idaho Code § 48-2102(1).

An operatorOperator"Operator" means a person who makes available a conversational AI service to the public. Section 48-2104 imposes heightened obligations on operators when interacting with minor account holders. Subsection (1) requires unconditional AI identity disclosure — either as a persistent visible disclaimer or through session-start disclosure with three-hour reminders. Unlike the general disclosure in § 48-2103(1), this is not conditioned on whether a reasonable person would be misled. Subsection (2) prohibits variable-reward engagement mechanics designed to increase minor engagement. Subsection (3) requires operators to prevent sexually explicit content generation for minors, including visual depictions, direct solicitation, and sexual objectification. Subsection (4) requires operators to prevent the AI from generating statements that would mislead minors into believing they are interacting with a human, covering sentience claims, emotional dependence simulation, romantic or sexual innuendo, and adult-minor romantic role-playing. Subsection (5) mandates privacy and account management tools for account holders, with a tiered parental access structure distinguishing between children under thirteen and minors thirteen and older.
The definition of "minor" in § 48-2102(4) requires actual knowledge or reasonable certainty, meaning all obligations in this section only apply where the operator meets that knowledge threshold.

(2) Civil penalties for violations of the provisions of this chapter are to be sought by the attorney general. Nothing in this chapter shall be construed as creating a private right of action to enforce the provisions of this chapter or to support a private right of action under any other law.
(3) This chapter shall not create liability for the developer of an AI model for any violation of this chapter by a conversational AI system that is made available to the public by a third-party operatorOperator"Operator" means a person who makes available a conversational AI service to the public. Operator does not include mobile application stores or search engines solely because they provide access to a conversational AI service.Idaho Code § 48-2102(6).
Section 48-2105 establishes the enforcement framework for the Conversational AI Safety Act. Subsection (1) sets civil penalties of $1,000 per violation with a $500,000 per-operator cap, or actual damages, whichever is greater, plus injunctive relief. Subsection (2) assigns exclusive enforcement authority to the attorney general and expressly disclaims any private right of action — including foreclosing the use of this chapter to support a private right of action under other law. Subsection (3) shields AI model developers from liability when a third-party operator makes the conversational AI system available to the public, placing compliance responsibility squarely on the entity that deploys the service to consumers.
