Regulates providers of chatbots — broadly defined as any AI system generating information that simulates interpersonal interactions — by imposing data privacy restrictions, transparency obligations, and safety requirements. Prohibits processing personal data beyond input data without affirmative consent, bans use of chat logs for advertising targeting, prohibits processing minor users' data for training, and bars the sale of chat logs. Requires clear AI identity disclosure before first output, every hour thereafter, and on user demand. Prohibits chatbot providers from implying outputs are provided by licensed professionals. Requires monthly risk assessments, public chatbot information disclosures, a written data security program, and user access to their own chat logs. Establishes strict product liability for chatbot providers and creates a private right of action with $5,000 liquidated damages per violation of data privacy provisions. Enforced by the Attorney General and State's Attorneys.
